IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2025-080 RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE AMENDMENT NO. 4 TO THE CONSULTING SERVICES AGREEMENT WITH TERRAPHASE ENGINEERING INC. FOR CONSTRUCTION ENGINEERING AND CONSTRUCTION MANAGEMENT SERVICES FOR A TREATMENT WETLAND, INCREASING THE NOT-TO-EXCEED AMOUNT BY $403,601 FOR A NEW TOTAL NOT TO EXCEED AMOUNT OF COMPENSATION OF $1,581,464 WHEREAS, the City of San Leandro’s Water Pollution Control Plant plans to repurpose an underutilized 6.9-acre wastewater retention pond on site into a multi-benefit treatment wetland; and WHEREAS, the City selected Terraphase Engineering through a competitive selection process and entered into an agreement on October 15, 2019 to support the planning phase of the project; and WHEREAS, the agreement was amended three times before to include modified designs based on updated project needs; and WHEREAS, the City requires construction engineering and construction management support for Phase 1 of the project; and WHEREAS, Terraphase provides construction engineering and management services and is familiar with the project requirements; and WHEREAS, a fourth amendment to add scope and fee related to additional construction management engineering and management is recommended by Staff for Council approval; and WHEREAS, the City Council is familiar with the contents of Amendment No. 4; and WHEREAS, the City Manager recommends approval of said amendment. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: 1. That the amendments to the agreement are approved and execution by the City Manager is authorized, including amendments to extend the term to June 30, 2027; and 2. That the amendment is approved to increase the total not to exceed amount of compensation by $403,601 for a new total not-to-exceed amount of compensation of $1,581,464; and 3. That the City Manager is authorized to take all actions and execute all documents necessary to effect the purpose and intent of this Resolution.
