IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2025-080 <br /> <br />RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE AMENDMENT NO. 4 <br />TO THE CONSULTING SERVICES AGREEMENT WITH TERRAPHASE ENGINEERING INC. FOR <br />CONSTRUCTION ENGINEERING AND CONSTRUCTION MANAGEMENT SERVICES FOR A TREATMENT <br />WETLAND, INCREASING THE NOT-TO-EXCEED AMOUNT BY $403,601 FOR A NEW TOTAL NOT TO <br />EXCEED AMOUNT OF COMPENSATION OF $1,581,464 <br /> <br />WHEREAS, the City of San Leandro’s Water Pollution Control Plant plans to repurpose an <br />underutilized 6.9-acre wastewater retention pond on site into a multi-benefit treatment wetland; and <br /> <br />WHEREAS, the City selected Terraphase Engineering through a competitive selection process <br />and entered into an agreement on October 15, 2019 to support the planning phase of the project; and <br /> <br />WHEREAS, the agreement was amended three times before to include modified designs based <br />on updated project needs; and <br /> <br />WHEREAS, the City requires construction engineering and construction management support for <br />Phase 1 of the project; and <br /> <br />WHEREAS, Terraphase provides construction engineering and management services and is <br />familiar with the project requirements; and <br /> <br />WHEREAS, a fourth amendment to add scope and fee related to additional construction <br />management engineering and management is recommended by Staff for Council approval; and <br /> <br />WHEREAS, the City Council is familiar with the contents of Amendment No. 4; and <br /> <br />WHEREAS, the City Manager recommends approval of said amendment. <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: <br /> <br />1. That the amendments to the agreement are approved and execution by the City Manager is <br />authorized, including amendments to extend the term to June 30, 2027; and <br /> <br />2. That the amendment is approved to increase the total not to exceed amount of compensation <br />by $403,601 for a new total not-to-exceed amount of compensation of $1,581,464; and <br /> <br />3. That the City Manager is authorized to take all actions and execute all documents necessary to <br />effect the purpose and intent of this Resolution. <br /> <br /> <br /> <br />
