IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2025-108 RESOLUTION TO IMPOSE LIENS FOR NON-PAYMENT OF DELINQUENT 2025 SOLID WASTE SERVICE CHARGES, SIDEWALK/DRIVEWAY REPAIRS, CERTIFIED UNIFIED PROGRAM AGENCY (CUPA) FEES, CODE COMPLIANCE AND ENFORCEMENT, FIRE INSPECTIONS, WPCP USER CHARGES PLUS ADMINISTRATIVE PENALTIES AND CHARGES WHEREAS, the City of San Leandro City Council reviewed the Reports of the Finance Director and Bearing List No. 2025-001 for Solid Waste Fees and Charges; List No. 2025-002 for Sidewalk Repairs; List No. 2025-003 for Driveway Repairs; List No. 2025-004 for CUPA Fees; List No. 2025-005 for Code Enforcement / Compliance; List No. 2025-006 for Fire Inspections; and List No. 2025-007 for WPCP User Charges, copies of which are attached hereto as Exhibit A and incorporated herein; and WHEREAS, all of said charges are currently unpaid and delinquent; and WHEREAS, pursuant to the San Leandro Municipal Code, notice was duly given of the time and place of hearing on said delinquent charges and upon any objections or protest by any of the property owners liable to be liened for non-payment of such delinquent charges; and WHEREAS, said hearing was regularly set for the hour of 7:00 p.m. on July 21, 2025; and WHEREAS, the City of San Leandro City Council has heard and passed on objections and protests of the property owners liable to be assessed for charges. NOW, THEREFORE, the City of San Leandro City Council hereby RESOLVES as follows: That the City of San Leandro City Council confirms the Reports of the Finance Director concerning non-payment of City service charges and Bearing List Numbers 2025-001, 2025-002, 2025-003, 2025- 004, 2025-005, 2025-006, and 2025-007; and BE IT FURTHER RESOLVED that said assessments of delinquent charges of the City of San Leandro are hereby approved and confirmed and a lien is hereby imposed upon said real property in the amount set therein; and BE IT FURTHER RESOLVED that a notice of lien shall be delivered to the County Auditor, who shall enter the amount thereof on the County Assessment Book opposite the description of the particular property and the amount shall be collected together with all other taxes thereon against the property; and BE IT FURTHER RESOLVED that the City Manager, or designee, may elect not to deliver a notice of lien for a particular property if the City Manager determines, in his or her discretion, that doing so serves the best interest of the City.
