All landscaping improvements shall be maintained in a healthy, <br />growing, and weed-free condition at all times. Any missing, dead, or damaged plant <br />and groundcover material shall be promptly replaced with a material similar in type <br />and comparable in size to the plant(s) or groundcover being removed. <br />24. Noise. The property shall comply with Municipal Code Chapter 4-1, Article 11 <br />(Noise). The Applicant/Owner shall take proactive measures to avoid and reduce <br />noise that would disturb the peace, quiet and comfort of neighboring residents or <br />persons of normal sensitivity between the hours of 10:00 p.m. and 8:00 a.m. Testing <br />of back-up generators or similar equipment that operates only during power outages <br />or other emergencies may only occur during standard daytime hours. <br />25. Warning Signs and Controlled Access. Prior to issuance of any building permits, <br />the Applicant/Owner shall. provide for review and approval by the Zoning <br />Enforcement Official installation details for the warning signs and controlled access <br />measures (security walls and gates) recommended by the EME report submitted for <br />this project. Prior to any building permit finals, the Applicant/Owner shall install the <br />signs and the security measures. <br />26. Discontinued Facilities and Removal of Abandoned Antennas and Towers. Any <br />wireless telecommunications facility that is not operated for a continuous period of <br />12 months shall be considered abandoned, and the owner of such facility shall <br />remove same, and restore the site to its pre-installation condition, within 90 days of <br />receipt of notice from the Community Development Department Director notifying the <br />owner of such abandonment. The notice shall specify that the owner has the <br />opportunity to request a public hearing on the removal of the facility. If such facility is <br />not removed within said 90 days, the Community Development Director may remove <br />such facility at the owner's expense. If there are two or more users of a single <br />facility, then this provision shall not become effective until all users cease using the <br />facility. <br />Any wireless telecommunications facility shall be removed within 30 calendar days <br />of the discontinuation of the use and shall be restored to its previous condition. The <br />service provider shall provide the Community Development Department with a notice <br />of intent to vacate the site a minimum of 30 calendar days prior to vacation and shall <br />obtain building permits prior to removal of equipment. For facilities located on City <br />property, this requirement shall be included in the terms of the lease. For facilities <br />located on other sites, the property owner shall be responsible for removal of all <br />antennas, structures and related equipment within 30 calendar days of the <br />discontinuation of use. <br />Improvements and Amenities <br />27. Screened Mechanical Equipment. All exterior mechanical equipment, such as air <br />conditioning/heating units and exhaust systems, shall be located such that they will <br />not be visible from any public-rights-of-way.
