<br />RESOLUTION NO. 2025-XXX 14 <br />PLANNING COMMISSION REQUIREMENTS <br />57. As required by Zoning Code Section 4.04.376.J.13, within 30 calendar days of activation of the facility, <br />the Applicant/Owner shall submit a Radio-Frequency Compliance Report demonstrating that the <br />facility meets the FCC standards for radio-frequency emissions. Additionally, the Applicant/Owner <br />shall complete a Radio-Frequency Compliance Report annually for five years after the approval of <br />this project. The report shall be delivered to the Planning Division on the anniversary of the approval. <br />58. If new development occurs on an adjacent parcel, the Applicant/Owner shall submit a Radio- <br />Frequency Compliance Report demonstrating that the facility meets the FCC standards for radio- <br />frequency emissions. <br />59. Upon notification by the City that an application for an entitlement or building permit, whichever <br />occurs first, has been submitted for the proposed development of a structure with a height greater <br />than 30 feet on 523 San Leandro Blvd, the Applicant/Owner shall submit a Radio Frequency <br />Emissions report identifying whether the proposed project on the adjacent property will result in the <br />facility violating the applicable FCC standards. Within 90 days, the Applicant/Owner shall make any <br />necessary adjustments to facility equipment, including removal if necessary, to ensure that the radio- <br />frequency emissions in the proposed adjacent building do not exceed FCC standards. The <br />Applicant/Owner shall submit additional Radio Frequency Report to confirm that the adjustments <br />have resulted in the elimination of any violation of application radio frequency emissions standards. <br />Introduced by Councilmember _____________ and passed and adopted this 21st day of January, <br />2025, by the following vote: <br /> <br />AYES: () <br /> <br />NOES: () <br /> <br />ABSENT: () <br /> <br /> <br />ATTEST: <br /> Kelly B.
