IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2025-XXX <br /> <br />RESOLUTION TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND APPROVE AN INCREASE IN THE <br />CUMULATIVE CHANGE ORDER AMOUNT FROM 15% TO 25% (FROM $532,582 TO $887,637) FOR <br />ANNUAL PAVING 21-23 REHABILITATION PHASE, PROJECT NO. 2022.0050 <br /> <br />WHEREAS, the City of San Leandro did on July 15, 2024 award a construction contract to DeSilva Gates <br />Construction by Resolution No. 2024-092 for the Annual Paving 21-23 Rehabilitation Project, Project No. <br />2022.0050; and <br /> <br />WHEREAS, unforeseen conditions in the subgrade on a major street in the project led to increases in bid <br />quantities; and <br /> <br />WHEREAS, in order to expedite the delivery of public projects on schedule and on budget, provide that <br />subcontractors and workers are paid in a timely fashion, avoid as much as possible costly delay claims, and <br />insure that the City completes projects and products that are to the City’s highest standards, the City Council <br />finds that providing authorization to negotiate and approve change orders is in the best interest of public health, <br />safety and welfare. <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: <br /> <br />That the City Manager or her designee is authorized to negotiate and approve cumulative change orders <br />up to a maximum of $887,637, which is 25% of the original contract amount. <br /> <br />Introduced by Councilmember _______________ and passed and adopted this 3rd day of March 2025 by <br />the following vote: <br /> <br />AYES: () <br /> <br />NOES: () <br /> <br />ABSENT: () <br /> <br /> <br />ATTEST: <br /> Kelly B.
