IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE NO. 2025-011 ORDINANCE VACATING APPROXIMATELY 996 LINEAR FEET OF PUBLIC RIGHT-OF-WAY COMMONLY KNOWN AS EDEN ROAD (APN: 042-4530-005-02) LOCATED BETWEEN DOOLITTLE DRIVE AND THE WESTERN TERMINUS WHEREAS, the City Council of City of San Leandro, on May 19, 2025, passed its Resolution of Intention No. 2025-047 to vacate a portion of Eden Road between Doolittle Drive and the western terminus as hereinafter described; and WHEREAS, a public hearing was set for July 7, 2025, at which time any person objecting to such vacation was given the opportunity to appear and show cause why such vacation should not be ordered, and notice of such meeting was duly published and posted; and WHEREAS, such hearing was held by the City Council on July 7, 2025, and the City Council at the time of such hearing determined that said portion of Eden Road between Doolittle Drive and the western terminus is unnecessary for present and prospective public use; and WHEREAS, the San Leandro Planning Commission found that the proposed vacation conforms to the requirements of the San Leandro General Plan. NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as follows: Section 1. Findings and determinations. The City Council hereby finds and determines that the above recitals are true and correct and have served as the basis, in part, for the findings and actions of the City set forth below. Section 2. No present or prospective public use. That the portion of Eden Road located within the City of San Leandro, Alameda County, California, as described in Exhibit A and depicted in Exhibit B, attached hereto and incorporated herein, unnecessary for present or prospective public uses. Section 3. Vacation of Right-of-Way Pursuant to Title 5, Chapter 5-4, Street and Easement Abandonment of the San Leandro Municipal Code, approximately 996 linear feet of Eden Road between Doolittle Drive and the western terminus is hereby vacated and abandoned. From and after the date this ordinance is recorded, a portion of Eden Road between Doolittle Drive and the western terminus shall no longer constitute a public street or highway. Section 4. Certification and Recordation of Ordinance. The City Clerk is hereby directed to record a certified copy of this Ordinance in the office of the Alameda County Recorder pursuant to Title 5, Chapter 5-4 of the San Leandro Municipal Code. DRAFT
