IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2025-XXX RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND APPROVE AN INCREASE IN THE CUMULATIVE CHANGE ORDER AMOUNT FROM 25% TO 43% (FROM $167,372 TO $287,879) FOR WICKS BOULEVARD AND MANOR BOULEVARD TRAFFIC SIGNAL UPGRADE PROJECT, PROJECT NO. 2020.5620; AND TO REAPPROPRIATE $509,564 FROM ACCOUNT NO. 143-38-392 TO ON-GOING PROJECTS WHEREAS, the City of San Leandro did on May 15, 2023 award a construction contract to Ray’s Electric by Resolution No. 2023-050 for the Wicks Boulevard and Manor Boulevard Traffic Signal Upgrade Project, Project No. 2020.5620; and WHEREAS, compliance with newly implemented and unanticipated PG&E standards and requirements has resulted in significant cost increases to the project; and WHEREAS, Section 520 of the San Leandro Municipal Code specifies that appropriations to capital funds may be carried forward for no more than five fiscal years; and WHEREAS, in order to expedite the delivery of public projects on schedule and on budget, provide that subcontractors and workers are paid in a timely fashion, avoid as much as possible costly delay claims, and insure that the City completes projects and products that are to the City’s highest standards, the City Council finds that providing authorization to negotiate and approve change orders is in the best interest of public health, safety and welfare. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That the City Manager or her designee is authorized to negotiate and approve cumulative change orders up to a maximum of $287,879, which is 43% of the original contract amount; and That the reappropriation of $509,564 in Account No. 143-38-392 to on-going projects is hereby authorized.
