RESOLUTION NO. 2025-144 2 WHEREAS, the City requires the assistance of professional consulting services; and WHEREAS, a CSA for the Bay Fair CBTP was previously authorized and initiated with a different consulting team; however, the City now intends to engage Fehr & Peers to complete the project; and WHEREAS, to avoid delay and maintain project momentum, staff proposes engaging Fehr & Peers to complete the Bay Fair CBTP based on their pre-approval through both the MTC/ABAG Regional Planning Bench and the City’s on-call consultant list for Engineering and Transportation services pursuant to San Leandro Municipal Code Sec. 1-6-315, the City Council finds that a waiver of the competitive selection process is justified; and WHEREAS, an agreement between the City and Fehr and Peers, a copy of which is attached and incorporated herein, is presented to the City Council; and WHEREAS, the City Council is familiar with the contents thereof; and WHEREAS, the City Manager recommends approval of said agreement. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That the City Council hereby awards a consulting services agreement in an amount not to exceed $225,000; and The City Manager (or her designee) is hereby authorized to finalize the scope of work for the preparation of the Bay Fair Community Based Transportation Plan; and The City Manager (or her designee) is hereby authorized and directed, on behalf of the City Council, to execute the attached consulting services agreement, in substantial form, on behalf of the City of San Leandro upon timely submission by Fehr and Peers of the signed agreement; and The City Manager (or her designee) is authorized to make all approvals and take all actions necessary or appropriate to carry out and implement the terms of the consulting services agreement and to administer the City of San Leandro’s obligations, responsibilities, and duties to be performed under the agreement.
