IN THE SAN LEANDRO HILLSIDE GEOLOGIC HAZARD ABATEMENT DISTRICT RESOLUTION NO. 2025-002 GHAD RESOLUTION OF THE BOARD OF DIRECTORS OF THE HILLSIDE DRIVE GEOLOGIC HAZARD ABATEMENT DISTRICT (“GHAD”) ORDERING DISSOLUTION OF THE GHAD PURSUANT TO PUBLIC RESOURCES CODE SECTIONS 26500-26654 WHEREAS, on November 8, 2000, the City Council for the City of San Leandro adopted Resolution No. 2000-172 establishing the Hillside Drive Geologic Hazard Abatement District (“GHAD”) under the authority of the California Public Resources Code Division 17, Sections 26500-26654, for the purpose of preventing, mitigating, and abating structural hazards caused by geologic hazards for 26 lots on Hillside Circle, in the Bay-O-Vista area of the City of San Leandro; and WHEREAS, the Plan of Control dated October 10, 2000, (Project No. 4867.1.002.01) (the “Plan”) as required under California Public Resources Code Section 26553, sets forth the plan for the prevention, mitigation, abatement and control of the GHAD; and WHEREAS, the Plan provides that the GHAD shall be funded by available state and FEMA funds, and in the event the “GHAD’s funding is, for any reason, exhausted, reduced, or eliminated in the future, the GHAD’s services will also be eliminated or diminished accordingly. The GHAD has no responsibility to perform any activities which exceed its funding capacity;” and WHEREAS, the GHAD’s funding is exhausted; and WHEREAS, there are no outstanding debts, liabilities, or obligations of the GHAD; and WHEREAS, all assets of the GHAD have been disposed of or, if any remain, will be transferred in accordance with applicable law and in the best interests of the property owners within the GHAD; and WHEREAS, on October 6, 2025, the GHAD Board of Directors adopted Resolution No. 2025-001 initiating the GHAD dissolution procedures and setting a public hearing pursuant to California Public Resources Code Division 17, Sections 26500-26654; and WHEREAS, notice of the Public Hearing to consider the dissolution of the GHAD was timely served in accordance with California Public Resources Code Section 26580; and WHEREAS, a Public Hearing to consider the dissolution of the GHAD was held on November 17, 2025; and WHEREAS, the GHAD Board has received objections by no more than 50 percent of the assessed valuation of the real property in the District, and reviewed the analysis provided by staff which concludes that the GHAD is no longer required; and WHEREAS, the Board of Directors makes one or more of the required findings under Public Resources Code Section 26567.1, that:
