<br />Consulting Services Agreement between City of San Leandro and Last revised [07/03/2025] <br />Rincon Consultants for Environmental Observation Exhibit A – Page 1 of 1 <br />EXHIBIT A <br /> <br />SCOPE OF SERVICES <br /> <br />Rincon Consultants, Inc. (Rincon) is to provide environmental consulting services to the City of San <br />Leandro (City) for the upcoming subsurface work. As background, the City is preparing to issue a grading <br />permit for the PACE facility development at 2420 Merced Street (site). The site has known subsurface <br />environmental impacts that have undergone investigation and remediation under oversight of the <br />Regional Water Quality Control Board (Water Board). Public access to files on the Water Board’s case <br />is available on the GeoTracker website under Case ID T0600191505. <br /> <br />The Water Board issued a No Further Action (NFA) letter for the site on November 25, 2024 based on <br />the current site configuration and use. However, due to the known and suspected presence of residual <br />chemicals of concern (COCs) in the subsurface, the site is subject to both a Covenant and <br />Environmental Restriction on Property (deed restriction) and a Site Management Plan (SMP) <br />(Geosyntec 20231). The deed restriction and SMP govern future activities on and use of the site. <br />The development plans call for subsurface work (i.e., excavation) of areas of the site that have been <br />preliminarily screened for COCs that could pose a risk to construction workers or future users of the <br />site, but this screening cannot definitively rule out the potential presence of environmental impacts. <br />The processes and procedures outlined in the SMP are intended to address this situation and should <br />be implemented during subsurface work. It is our understanding the developer has engaged Partner <br />Engineering and Science, Inc. (Partner) to act as their Environmental Professional (EP) and implement <br />the SMP. <br /> <br />As a result of the City’s engagement with the developer and Partner through grading permit process, <br />the City has deemed it prudent to request Rincon submit a proposal to provide third-party EP <br />observation of subsurface work. Therefore, Rincon’s proposes to confirm on behalf of the City all work <br />is being done in compliance with the SMP, provide guidance to Partner where needed, and keep the <br />City informed of developments on site. <br /> <br />Based on the approximate one- to two-month schedule for the subsurface work, we have assumed <br />Rincon will have a field staff member on site full time (40 hours per week) to provide observation for <br />the first two weeks, and an average of 4 hours per day for the following six weeks. We have also <br />assumed 20 hours of Principal support for grading permit and SMP compliance consultation. <br />Rincon is prepared to start with the services in this proposal immediately upon authorization. The <br />estimated cost for the scope of work described above is $38,304. The project will be charged on a time and <br />materials basis and is assumed to be completed in 2025.
