IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2026-028 RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A CONSULTING SERVICES AGREEMENT WITH NICHOLS CONSULTING ENGINEERS, CHTD (DBA NCE) IN THE AMOUNT OF $137,395 TO DEVELOP A PAVEMENT CUT IMPACT FEE STUDY; AND TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND APPROVE AMENDMENTS FOR UP TO 10% (OR $13,739) OF THE ORIGINAL AGREEMENT AMOUNT WHEREAS, the City of San Leandro is responsible for maintaining and preserving its public street system in a safe and serviceable condition; and WHEREAS, utility pavement cuts within the public right-of-way accelerate pavement deterioration and reduce pavement service life, resulting in increased long-term maintenance and rehabilitation costs; and WHEREAS, the City seeks to develop a defensible, data-driven Pavement Cut Impact Fee Study to evaluate the structural and functional impacts of utility pavement cuts and to support future policy decisions related to cost recovery and pavement preservation; and WHEREAS, Nichols Consulting Engineers, CHTD. (dba NCE) possesses specialized professional expertise in pavement engineering and has successfully completed similar pavement cut and impact fee studies for numerous California jurisdictions; and WHEREAS, California law permits the procurement of professional services based on demonstrated qualifications and specialized expertise without a competitive request for proposals process; and WHEREAS, NCE has agreed to the terms of the agreement pending Council approval; and WHEREAS, the Consulting Service Agreement was presented to this City Council; and WHEREAS, the City Council is familiar with the contents thereof; and WHEREAS, the City Manager recommends approval of said agreement. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That said consultant services agreement is hereby approved in the amount of $137,395 and execution by the City Manager is hereby authorized; and That the City Manager is authorized to negotiate and approve amendments for up to 10% of the original agreement amount, or $13,739.
