<br />Amendment No. 1 to <br />Consulting Services Agreement between City of San Leandro Last revised April, 2026 <br />NCE for Lewelling Boulevard Class IV Bike Ways Project Page 1 of 4 <br />AMENDMENT NO. 1 TO CONSULTING SERVICES AGREEMENT BETWEEN <br />THE CITY OF SAN LEANDRO AND <br />NICHOLS CONSULTING ENGINEERS, CHTD. (dba NCE) <br />FOR <br />LEWELLING BOULEVARD CLASS IV BIKE WAYS PROJECT <br /> <br />This Amendment No. 1 (“Amendment”) is made by and between the City of San Leandro (“City”) <br />and NCE (“Consultant”) (together sometimes referred to as the “Parties”) as of ______________, 2026, <br />and amends that certain Consulting Services Agreement ( “CSA” or “Agreement”) dated July 24, 2025, <br />between the Parties. <br /> <br />WHEREAS, City and Consultant have executed the Agreement, pursuant to which Consultant has <br />provided certain consulting services to City with regard to Lewelling Boulevard Class IV Bike Ways Project, <br />and <br /> <br />WHEREAS, the Parties desire to amend the Agreement to include a cultural study and additional <br />coring for the Lewelling Boulevard Class IV Bike Ways Project. <br /> <br />WHEREAS, the CSA was approved by the Council on July 7,2025 per Council Resolution Number <br />2025-087. <br /> <br />NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby <br />acknowledged, the Parties hereby agree to amend the Agreement as follows: <br /> <br />1. Section 2 of the Agreement entitled “Compensation” is hereby amended to pay Consultant a <br />sum not to exceed FIVE HUNDRED AND FORTY THOUSAND AND NINE DOLLARS AND NO CENTS <br />($540,009), which is an increase of $30,009; and <br /> <br />2. Exhibit A of the Agreement entitled “Scope of Services” is hereby amended to include: <br /> <br />Task 4B Limited Pavement Coring <br /> <br />Additional coring to confirm the thickness on the following select streets: <br /> 1. Calgary St <br /> 2. Edgemoor St <br /> 3. Churchill St <br /> 4. Beatty St <br /> 5.
