~~ <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2001- 132 (2465/1409) <br />RESOLUTION APPROVING THE SMART CORRIDOR MEMORANDUM OF <br />UNDERSTANDING, COOPERATIVE AGREEMENT FOR DESIGN, CONSTRUCTION <br />AND ADMINISTRATION AND THE COOPERATIVE AGREEMENT FOR OWNERSHII', <br />OPERATION AND MAINTENANCE OF SMART CORRIDORS BETWEEN THE CITY OF <br />SAN LEANDRO AND THE ALAMEDA COUNTY CONGESTION MANAGEMENT <br />AGENCY (CMA) <br />WHEREAS, the Memorandum of Understanding (MOU) is an agreement of all <br />participating agencies to work cooperatively to improve the management and operation of the <br />parallel arterials along the I-880 corridor transportation system. This MOU is not a legally <br />binding contract-it constitutes a guide to-the intentions and policies of the participating <br />agencies; and, <br />WHEREAS, the participating agencies propose to enter into a cooperative agreement for <br />the design, construction, contract administration, ownership, operation and maintenance of all <br />improvements along the I-880 Corridor; and <br />WHEREAS, said cooperative agreements will be between all participating agencies and <br />the Alameda County Congestion Management Agency (CMA); and <br />WHEREAS, said cooperative agreements designate CMA to be the party responsible for <br />the design, construction and administration of the project while delegating the ownership, <br />operation and maintenance to each participating agency; <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San <br />Leandro does hereby approve the SMART Corridor Memorandum of Understanding, <br />Cooperative Agreement for Design, Construction and Administration and the Cooperative <br />
