-kyle <br />WX66049 Rr . 03 !M:7?0 <br />GRANT OF EASEMENT <br />JOHN MADDOX, hereinafter called ''Grantor,'' for and in consideration <br />of the sum of One Dollar ($1), receipt of which is hereby acknowledged, does <br />hereby grant to the City of San Leandro, a municipal corporation, herein- <br />after called ''City,'' its successors and assigns, an easement for the purpose <br />and upon the conditions hereinafter set forth, upon, along and under that <br />certain strip of real property in the City of San Leandro, County of Alameda, <br />State of California, described as follows: <br />A ten -foot wide strip of land, the southwestern line of said <br />strip being the southwestern line of the parcel of land <br />described in the deed from Scoble, Inc. to John Maddox <br />and Daisy Maddox, his wife, recorded September 26, 1946, <br />in Book 5002, page 25, Official Records of Alameda County. <br />Said easement is and shall be subject to each and all of the following <br />provisions, conditions and covenants: <br />Said easement shall be for the purpose of constructing and maintaining <br />a sanitary sewer. Work to be performed by the City shall be done in such <br />a manner that possible damage to existing structures, paving, plants and <br />other improvements shall be minimized. If existing improvements are damaged, <br />said improvements shall be repaired or the same replaced in kind by the City. <br />In consideration of the easement granted, City agrees to: <br />1. Replace the existing driveway with a concrete driveway four inches <br />(411) thick. <br />2. Replace the existing garage slab with a concrete foundation and <br />slab fourteen feet (14') by twenty-three feet (23'). <br />3. Restore the existing structures and ground conditions affected by <br />the construction to a state of good repair upon completion of the work. <br />4. Grantor shall retain the right to build upon the easement granted <br />a garage of wood frame construction to be used primarily for storage of the <br />Grantor's automobile or automobiles. <br />
