City of San Leandro <br />City Council <br />Meeting Date: December 5, 2022 <br />Agenda Number: 12.a. <br />Agenda Section: PUBLIC HEARINGS <br />File Number: 22-677 <br />File Type: Staff Report <br />Adopt an Ordinance Amending Articles 1, 3 through 9 and 10A of Title 7 “Maps, Buildings and <br />Subdivisions” Chapter 7-5 “Building Code” of the San Leandro Municipal Code in Order to Adopt by <br />Reference the 2022 Edition of the California Building Standards Code and 2018 International Property <br />Maintenance Code, with Local Amendments <br />COUNCIL PRIORITY <br />·Public Safety <br />·Sustainability & Resiliency <br />SUMMARY <br />On October 17, 2022, the City Council introduced an Ordinance for First Reading to adopt the <br />2022 California Building Standards Code. A second reading and public hearing were held on <br />November 7, 2022, at which time a Resolution was adopted with findings justifying local <br />amendments based on local climatic, geologic, and topographic conditions. The California <br />Building Standards Code and the local climatic, geologic, and topographic conditions will go into <br />effect January 1, 2023. <br />Because the Ordinance was drafted as noticed in accordance with Government Code Section <br />6066, for full transparency a re-noticed public hearing and second reading of the Ordinance are <br />being held in accordance with the Government Code Section 6066 noticing procedures . <br />The 2022 California Building Standards Code and local amendments will go into effect on <br />January 1, 2023. <br />The content of the Ordinance and attached articles is the same as the November 7 agenda <br />packet with the exception of the dates. <br />RECOMMENDATIONS <br />Staff recommends that the City Council hold a second public hearing on the adoption of the <br />Building Standards Code that would confirm the following: <br />a)Amend Municipal Code Chapter 7-5 by repealing and replacing the 2016 and 2019 <br />editions and adopt the 2022 editions of the California Building Code, Residential Code, <br />Electrical Code, Mechanical Code, Plumbing Code, Energy Code, Fire Code, Existing <br />Building Code, and Green Building Standards Code. Additionally, adopt by reference the <br />International Property Maintenance Code; and <br />b)Adopt local amendments regarding certain structural design requirements, fire sprinkler <br />regulations, “reach codes,” and other building requirements to advance the health, welfare, <br />Page 1 City of San Leandro Printed on 11/30/2022
