<br />Amendment No. 2 to <br />Consulting Services Agreement between City of San Leandro and Whitewater West Industries Ltd. <br />for Washington Manor Pool Renovation - Play structure Page 1 of 3 <br />AMENDMENT NO. 2 TO CONSULTING SERVICES AGREEMENT BETWEEN <br />THE CITY OF SAN LEANDRO AND <br />WHITEWATER WEST INDUSTRIES LTD. <br />FOR <br />WASHINGTON MANOR POOL RENOVATION - PLAYSTRUCTURE <br /> <br /> <br />This Amendment No.2 (“Amendment”) is made by and between the City of San Leandro (“City”) <br />Whitewater West Industries Ltd. (“Consultant”) (together sometimes referred to as the “Parties”) as of <br />_________________________, 2025, and amends that certain Consulting Services Agreement ( “CSA” or <br />“Agreement”) dated June 21st , 2023, between the Parties. <br /> <br />WHEREAS, City and Consultant have executed the Agreement, pursuant to which Consultant has <br />provided certain consulting services to City with regard to Washington Manor Pool Renovation Project <br />No.2023.3400, and <br /> <br />WHEREAS, the Parties desire to amend the Agreement to include additional services. <br /> <br />NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby <br />acknowledged, the Parties hereby agree to amend the Agreement as follows: <br /> <br />1. Section 1.1 of the Agreement entitled “Term of Services” is hereby amended to extend the <br />term from July 31, 2024, to June 31, 2025; and <br /> <br />2. Section 2 of the Agreement entitled “Compensation” is hereby amended to pay Consultant a <br />sum not to exceed $427,264.00; and <br /> <br />3. Exhibit A of the Agreement entitled “Scope of Services” is hereby amended to include the <br />following: <br /> <br />Additional Tasks <br />1.0 Return Trip to complete Commissioning of AP150 <br /> <br />$7,000.00 <br />1.1 Inspection of Poolsider Slide (See Asbuilts for reference <br />Job. No. 210-62-002 DWG 2990.05 CASE 901) <br /> <br />$1,500.00 <br />1.2 Certification of Slide – Recommissioning ( See Asbuilts for <br />reference Job. No. 210-62-002 DWG 2990.05 CASE 901) <br /> <br />$1,500.00 <br /> <br /> <br /> <br />4.
