<br />Amendment No. 2 to <br />Consulting Services Agreement between City of San Leandro and Terraphase Engineering, Inc. <br />for 3rd Party Of Soil Screening And Analysis For Imported Soil For The Monarch Bay Golf <br />Course Grading Project Page 1 of 3 <br />AMENDMENT NO. 2 TO CONSULTING SERVICES AGREEMENT BETWEEN <br />THE CITY OF SAN LEANDRO AND <br />TERRAPHASE ENGINEERING, INC. <br />FOR <br />3rd PARTY OF SOIL SCREENING AND ANALYSIS FOR IMPORTED SOIL FOR THE MONARCH BAY <br />GOLF COURSE GRADING PROJECT <br /> <br />This Amendment No.2 (“Amendment”) is made by and between the City of San Leandro (“City”) <br />and Terraphase Engineering, Inc. (“Consultant”) (together sometimes referred to as the “Parties”) as of <br />______________________________________, and amends that certain Consulting Services Agreement ( <br />“CSA” or “Agreement”) dated October 10, 2023, between the Parties. <br /> <br />WHEREAS, City and Consultant have executed the Agreement, pursuant to which Consultant has <br />provided certain consulting services to City with regard to 3rd party of soil screening and analysis for <br />imported soil for the monarch bay golf course grading project, and <br /> <br />WHEREAS, the Parties desire to amend the Agreement to include additional services. <br /> <br />NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby <br />acknowledged, the Parties hereby agree to amend the Agreement as follows: <br /> <br />1. Section 1.1 of the Agreement entitled “Term of Services” is hereby amended to extend the <br />term from December 31, 2025, to June 30th, 2026; and <br /> <br />2. Section 2 of the Agreement entitled “Compensation” is hereby amended to pay Consultant a <br />sum not to exceed $55,860.00; and <br /> <br />3. Exhibit A of the Agreement entitled “Scope of Services” is hereby amended to include: <br /> <br />Task 3 - Additional Services required for the completion of Task 2 due to new import soil locations and <br />additional review and analysis of 10,000 CY of material; Services may include sample collection and 3rd <br />party lab coordination. <br /> <br />4. Exhibit B of the Agreement entitled “Compensation Schedule & Reimbursable Expenses” is <br />hereby amended to include: <br /> <br /> <br />Amendment 2: <br />Task 4 Additional Services required for the completion of Task 2 due to new import soil <br />locations and additional review and analysis of 10,000 CY of material; Services <br />may include sample collection and 3rd party lab coordination. <br />$20,000 (New) <br />Original Contract: $20,000.00 <br />Amendment No. 1: $15,860.00 <br />New P.O.
