IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2025-173 <br /> <br />RESOLUTION TO AUTHORIZE A LIMITED WAIVER OF THE ATTORNEY-CLIENT PRIVILEGE FOR <br />PURPOSES OF RELEASING THE DRAFT 2024 REVENUE MEASURE TRACKING SURVEY RESULTS IN <br />RESPONSE TO A PUBLIC RECORDS ACT REQUEST <br /> <br />WHEREAS, the City received a Public Records Act request seeking the Revenue Measure Tracking <br />Survey Results; and <br /> <br />WHEREAS, the requested document constitutes attorney-client privileged communication under <br />Evidence Code § 950 et seq.; and <br /> <br />WHEREAS, the privilege belongs to the City Council and may be waived only upon its express <br />authorization; and <br /> <br />WHEREAS, the City Council desires to waive the privilege solely for this specifically identified <br />document and not for any other communication. <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: <br /> <br />A limited waiver of attorney-client privilege for the document titled Revenue Measure Tracking <br />Survey Results, dated June 2024, is hereby authorized; and <br /> <br />The City Council directs the City Attorney and City Clerk to release the document to any <br />requesting parties; and <br /> <br />The City Council states expressly that the waiver applies only to this document and shall not be <br />construed as a waiver of privilege regarding any other communication. <br /> <br />Introduced by Councilmember Viveros-Walton and passed and adopted this 15th day of December <br />2025 by the following vote: <br /> <br />AYES: Councilmembers Boldt, Bowen, Simon, Viveros-Walton, Mayor González (5) <br /> <br />NOES: Councilmembers Azevedo, Aguilar (2) <br /> <br />ABSENT: None (0) <br /> <br />ATTEST: <br /> Sarah K.
