IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2026-031 RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO SUBMIT A CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT AFFORDABLE HOUSING AND SUSTAINABLE COMMUNITIES (AHSC) ROUND 10 PROGRAM APPLICATION TOGETHER WITH PACIFIC WEST COMMUNITIES, ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH ALAMEDA COUNTY TRANSPORTATION COMMISSION, AND SHOULD GRANT FUNDS BE AWARDED, EXECUTE DOCUMENTS TO ACCEPT THE PROGRAM FUNDS FOR THE BAY FAIR APARTMENT PROJECT WHEREAS, the State of California is accepting applications for funding under the Affordable Housing and Sustainable Communities (AHSC) Program established under Division 44, Part 1 of the Public Resources Code commencing with Section 75200; and WHEREAS, the City of San Leandro, Alameda County Transportation Commission (Alameda CTC), and Pacific West Communities each have projects that when combined qualify for funding under the Program; and WHEREAS, only two entities can be listed on the funding application. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: 1. That the City Manager may submit on behalf of the City an AHSC Round 10 Program Application as co-applicant with Paciﬁc West Communities in a total amount not to exceed $50,000,000 of which up to $35,000,000 is requested as a loan for an Affordable Housing Development, and up to $15,000,000 is requested for a grant for Housing-Related Infrastructure, Sustainable Transportation Infrastructure, Transit-Related Amenities, or Program activities as deﬁned in the AHSC Program Guidelines; and 2. That the memorandum of understanding (MOU) with the Alameda CTC is approved and the City Manager is authorized to execute the MOU with Alameda CTC obligating Alameda CTC to construct certain improvements and obligating the City to forward certain proceeds from the Program Funds to Alameda CTC, in the event the Program Funds are awarded to the City; and 3. That if the application is approved, the City Manager may execute a State of California Standard Agreement in a total amount not to exceed $15,000,000, and any and all other documents required or deemed necessary or appropriate to secure the AHSC Program funds from the Department of Housing and Community Development (Department) and all amendments thereto included an AHSC Program Application and AHSC Documents as required by the Department for participation in the AHSC Program; and 4. That the City Manager is authorized to take all actions and execute all documents necessary, including making non-substantial revisions to said MOU with Alameda CTC, subject to approval as to form by the City Attorney.
