<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />ORDINANCE NO. 2006-008 <br /> <br />(1055/3078) <br /> <br />AN ORDINANCE ESTABLISHING PROCEDURES FOR <br />THE CONDUCT OF RUNOFF ELECTIONS <br /> <br />WHEREAS, Section 610 of Article VI of the City Charter provides that the Council, by <br />ordinance, may provide for the method of conducting municipal elections; and <br /> <br />WHEREAS, Section 225(b) of Article II of the City Charter provides that in the event <br />that no candidate for the offices of the Mayor or City Council receives at least 50% plus one of <br />the votes cast for that office, the City Council shall provide for a runoff vote to determine the <br />person elected; and <br /> <br />WHEREAS, Section 225(c) of Article II of the City Charter specifies that the City <br />Council shall adopt an ordinance establishing a runoff system for conducting the election. <br /> <br />NOW, THEREFORE, The City Council of the City of San Leandro does ORDAIN as <br />follows: <br /> <br />Section 1. The City of San Leandro shall conduct any runoff election necessary pursuant <br />to Charter Section 225(b) among the two persons having the highest number of votes for that <br />office. <br /> <br />Section 2. A request shall be made to the Alameda County Board of Supervisors to <br />permit the consolidation ofthe City's Municipal Runoff Election with the Statewide General <br />Election in November following the City's General Municipal Election, and to direct the <br />Alameda County Registrar of Voters to provide all necessary services related to the runoff <br />election and to bill the City for the cost of conducting said election. <br /> <br />Section 3. Candidates participating in the runoff election may file a new candidate <br />statement, limited to 200 words, with the City Clerk during normal office hours, not earlier than <br />the 113th day nor later than the 88th day before the runoff election. The statement may be <br />withdrawn, but not changed, until 5:00 p.m. ofthe next working day after the 88th day before the <br />election. If a candidate elects not to file a new candidate statement, the City Clerk shall cause to <br />be published in the voter's pamphlet for the runoff election the candidate statement submitted by <br />the candidate for the General Municipal Election, unless otherwise instructed by the candidate. <br /> <br />Section 4. The candidates shall pay a deposit, to be specified at the time of the call for <br />the runoff election, of their pro-rata share of the costs of printing, handling, translating and <br />mailing their candidate statement included in the voter's pamphlet. <br /> <br />Section 5. Ordinance No. 2004-012 is hereby repealed in its entirety. <br />
