Ll <br />City of San Leandro <br />Civic Center, 835 E. 14th Street <br />San Leandro, California 94577 <br />Office of the City Manager 510-577-3351 <br />FAX 510-577-3340 <br />March 22, 2006 <br />Mr. Louie Pellegrini <br />Vice President <br />Alameda County Industries, Inc. <br />601 Aladdin Avenue <br />San Leandro, CA 94577 <br />RE: SIXTH AMENDMENT TO FRANCHISE AGREEMENT <br />Dear Mr. Pellegrini: <br />Flu <br />This letter (the "Amendment") is the sixth amendment to that certain Franchise Agreement for Solid <br />Waste, Recyclables, and Green Waste Services between the City of San Leandro and Alameda County <br />Industries, Inc., dated February 1, 2000 (the "Agreement"). <br />For good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the <br />City of San Leandro and Alameda County Industries, Inc., hereby agree as follows: <br />Per the recommendations provided by R3 Consulting Group, Inc. in the "5 -Year Review and <br />Assessment of Contract Services Provided By Alameda County Industries - Final Report", <br />Alameda County Industries agrees to: <br />A. Prepare a comprehensive rate schedule each March 15 for the term of the Agreement that <br />includes all rates, fees and proposed increases for review and approval by the City; <br />B. Conduct a residential route audit to confirm billings are consistent with service levels <br />provided prior to each five-year performance review; <br />C. Include acknowledgement of the annual audit of billings conducted by an independent <br />certified public accountant in the annual financial report due each November 1 of the <br />term of the Agreement; <br />D. Conduct driver performance audits and submit results (i.e. Safety and Quality Service <br />Observation Feedback Forms) and a schedule of future audits to the City on a quarterly <br />basis for review; <br />E. Replace or refurbish all collection containers that do not meet the specifications outlined <br />in Exhibit E of the Agreement by June 30, 2006; <br />F. Provide a report of collection container replacement and refurbishment activities in each <br />quarterly report submitted to the City for the term of the Agreement; <br />G. Review commercial recycling data from quarterly reports and develop a commercial <br />recycling plan by June 30, 2006; and <br />
