The City of San Leandro recorded a covenant on the property in the City of San Leandro, California identified as Assessor's Parcel Number 077 A-0675-013 and Assessor's Parcel Number 077 A- 0675-014 on August 2, 1978, Series No. 78-147664, Reel 5513, Image 541, of Official Records, providing for certain improvements to be made to the property (the "Covenant"). B. The Redevelopment Agency of the City of San Leandro and Harmon and Elaine Shragge entered into an Owner Participation Agreement on April 6, 1992, recorded May 6, 1992, Series No. 92139530, of Official Records, imposing requirements on the use of the property in the City of San Leandro, California identified as Assessor's Parcel Number 077 A-0675-013 and Assessor's Parcel Number 077A-0675-014 (the .Shragge OPA"). C. The purpose of this document is to memorialize the termination of both the Covenant and the Shragge OPA, which is superseded by a subsequent owner participation agreement between Costco Wholesale Corporation and the Redevelopment Agency of the City of San Leandro. D. Elaine Shragge is now deceased and Harmon Shragge, as sole surviving trustee, UITIA dated July 20, 1990, is the sole surviving signatory to the Covenant and the Shragge OPA on behalf of the property owner.
