<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />ORDINANCE NO. 2006-017 <br /> <br />(2799/3076) <br /> <br />AN INTERIM URGENCY ORDINANCE PROHIBITING CONSIDERATION AND <br />AFPROV AL OF USE PERMITS, VARIANCES, OR OTHER PLANNING ENTITLEMENTS, <br />EXCEPT AS MAY BE APPROVED ADMINISTRATNELY ON A SHORT-TERM BASIS BY <br />THE CITY MANAGER, FOR CERTAIN PROPERTIES WITHIN THE CITY FOR A FORTY- <br />FNE DAY PERIOD. <br /> <br />The City Council of the City Of San Leandro does ORDAIN as follows: <br /> <br />Section 1. <br /> <br />Findings <br /> <br />A. In 2005, the City of San Leandro became a recipient of a $450,000 pilot planning <br />grant from the Metropolitan Transportation Commission (MTC) to assist local governments in <br />developing land use plans and policies for areas immediately surrounding bus, ferry and train <br />stations. <br /> <br />B. The Downtown San Leandro Transit-Oriented Development Strategy (Strategy) will <br />articulate and quantify the potential ofthe greater downtown area for transit-oriented development. <br />Comprehensive land use policies will be developed along with a detailed land use map that reflect <br />the benefits of enhanced bus service through the downtown and improved connectivity to the BART <br />system. Selected opportunity sites will be studied to provide more specific guidance for future <br />development. <br /> <br />C. The Strategy is currently under preparation, and is expected to be completed in July <br /> <br />2007. <br /> <br />D. As part of the Existing Conditions Report and Market Assessment Study, 39 <br />opportunity sites were identified in the Strategy area (lI2-mile radius from Davis Street/E. 14th Street <br />intersection). These sites, ranging in size from 0.2 to 11.6 acres, were considered to be optimally <br />sized and located to allow for transit-oriented, mixed-use development in the downtown area. Due to <br />their underutilized or undeveloped status, they present an opportunity to act as near-term <br />development catalysts for on-going downtown revitalization and transit usage. <br /> <br />E. In their review of the opportunity sites, the Citizens Advisory Committee for the <br />Strategy expressed concern over development of the opportunity sites that might occur prior to <br />completion of the Strategy. <br /> <br />F. The City Council finds that it is necessary to allow for the completion ofthe Strategy, <br />in particular that the Strategy will provide direction for future development of the identified <br />opportunity sites, before potentially long-term uses/development is allowed to take place. <br /> <br />G. Based on the foregoing, the City Council finds that issuing permits, or other <br />applicable planning approvals, with the exception of certain temporary uses as may be deemed <br />
