IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO

ORDINANCE NO. 2006-017

(2799/3076)

AN INTERIM URGENCY ORDINANCE PROHIBITING CONSIDERATION AND
AFPROV AL OF USE PERMITS, VARIANCES, OR OTHER PLANNING ENTITLEMENTS,
EXCEPT AS MAY BE APPROVED ADMINISTRATNELY ON A SHORT-TERM BASIS BY
THE CITY MANAGER, FOR CERTAIN PROPERTIES WITHIN THE CITY FOR A FORTY-
FNE DAY PERIOD.

The City Council of the City Of San Leandro does ORDAIN as follows:

Section 1.

Findings

A. In 2005, the City of San Leandro became a recipient of a $450,000 pilot planning
grant from the Metropolitan Transportation Commission (MTC) to assist local governments in
developing land use plans and policies for areas immediately surrounding bus, ferry and train
stations.

B. The Downtown San Leandro Transit-Oriented Development Strategy (Strategy) will
articulate and quantify the potential ofthe greater downtown area for transit-oriented development.
Comprehensive land use policies will be developed along with a detailed land use map that reflect
the benefits of enhanced bus service through the downtown and improved connectivity to the BART
system. Selected opportunity sites will be studied to provide more specific guidance for future
development.

C. The Strategy is currently under preparation, and is expected to be completed in July

2007.

D. As part of the Existing Conditions Report and Market Assessment Study, 39
opportunity sites were identified in the Strategy area (lI2-mile radius from Davis Street/E. 14th Street
intersection). These sites, ranging in size from 0.2 to 11.6 acres, were considered to be optimally
sized and located to allow for transit-oriented, mixed-use development in the downtown area. Due to
their underutilized or undeveloped status, they present an opportunity to act as near-term
development catalysts for on-going downtown revitalization and transit usage.

E. In their review of the opportunity sites, the Citizens Advisory Committee for the
Strategy expressed concern over development of the opportunity sites that might occur prior to
completion of the Strategy.

F. The City Council finds that it is necessary to allow for the completion ofthe Strategy,
in particular that the Strategy will provide direction for future development of the identified
opportunity sites, before potentially long-term uses/development is allowed to take place.

G. Based on the foregoing, the City Council finds that issuing permits, or other
applicable planning approvals, with the exception of certain temporary uses as may be deemed
