<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />ORDINANCE NO. 2007-001 <br /> <br />(3075) <br /> <br />AN ORDINANCE OF THE CITY OF SAN LEANDRO AMENDING SAN LEANDRO <br />ZONING CODE: PART Il, ARTICLE 5, ADDING NEW SECTIONS 2-537 AND 2-539, AND <br />AMENDING SECTIONS 2-574,2-580,2-582 AND 2-584; AND PART IV, ARTICLE 17, <br />AMENDING SECTION 4-1704 <br /> <br />The City Council of the City or San Leandro does ORDAIN as follows: <br /> <br />SECTION I: Part II, Article 5 of the Zoning Code is hereby amended to read as follows: <br /> <br />[New Section] 2-537 Daylight Planes in R Districts <br /> <br />Daylight Planes are intended to provide for light and air, and to limit the impacts of bulk <br />and mass on adjacent properties. "Daylight Plane" means a height limitation that, when <br />combined with the maximum height limit, defines the building envelope within which all <br />new structures or additions must be contained. The daylight plane may further limit the <br />height or horizontal extent of the building at any specific point where the daylight plane <br />is more restrictive than the height limit applicable at such point on the site. The daylight <br />plane shall be measured separately for each building on a lot, and separately for each <br />side of each building. <br /> <br />A. Applicability. Daylight planes are established for lots zoned RS, RS-40, <br />RS-VP, RO, RD. <br /> <br />B. Dayliqht Plane. A daylight plane shall begin at a horizontal line 19 feet, 6 <br />inches above the grade of each side setback line of each lot and shall <br />slope inwards at a 45 degree angle. (Please refer to Residential Daylight <br />Plane illustration). <br /> <br />No portion of the structure shall intrude beyond the daylight plane except <br />as provided for in Section 4-1654 Building Projections into Yards and <br />Courts. <br /> <br />C. Exceptions. Exceptions may be granted with administrative approval by <br />the Zoning Enforcement Official (per Section 5-574, as amended). <br />
