<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />ORDINANCE NO. 2007-004 <br /> <br />(2557) <br /> <br />AN ORDINANCE AMENDING CHAPTER 3-1, TITLE 3 <br />OF THE SAN LEANDRO MUNICIPAL CODE RELATING TO <br />UNLAWFUL PROPERTY NUISANCE - PRIVATE PROPERTY <br /> <br />The City Council of the City of San Leandro does ORDAIN as follows: <br /> <br />Section 1. <br /> <br />Section 3-1-200(h) is amended to add subsection (5) to read as follows: <br /> <br />(5) Vehicles which exceed the following dimensions: twenty (20) feet in <br />length or seven (7) feet in width or seven (7) feet in height, or any single vehicle or combination <br />of vehicles having a manufacturer's gross vehicle weight rating of ten thousand (10,000) pounds <br />or more parked upon any paved or unpaved surface lying within any front yard, street comer side <br />yard, or backyard of any residential property which are visible from the street or visible from <br />adjacent private property, upon receipt of consent to inspect from any person owning, leasing, <br />renting, occupying or having charge or possession of such adjacent private property. <br />Recreational vehicles as defined by California Vehicle Code S 242,243,324, and 362 are <br />exempt from this provision. However, at no time shall more than one such recreational vehicle <br />be stored on any residential property at any time. <br /> <br />Section 2. <br /> <br />Effective Date and Publication. <br /> <br />This ordinance shall take effect thirty (30) days after adoption and the title thereof shall <br />be published once prior to adoption. <br /> <br />Section 3. <br /> <br />Severability. <br /> <br />If any section, subsection, subdivision, paragraph, sentence, clause or phrase of the <br />ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any court of <br />competent jurisdiction, such decision shall not affect the validity or effectiveness of the <br />remaining portions of this Ordinance or any part hereof. The City Council hereby declares that it <br />would have passed each section of the Ordinance irrespective of the fact that one or more of <br />them would be declared unconstitutional or invalid. To this end, the provisions of the Ordinance <br />are declared to be severable. <br /> <br />930148-4 <br />
