Holliste~stant City Manager <br /> <br />From: <br /> <br />Subject: <br /> <br />Reconsideration of Letter ofIntent to Support the Formation of the East <br />Bay Regional Communications System (EBRCS) <br /> <br />The City Council, at the April 16, 2007 meeting, approved a Letter ofIntent (LOI) to join <br />in the East Bay Regional Communications System Task Force's efforts to create a joint <br />powers authority (JP A) to establish a regional interoperable radio communications <br />system for all jurisdictions in Alameda and Contra Costa Counties. The City Council's <br />unanimous approval of the Letter of Intent (copy attached) also requires a "good faith" <br />payment of $1 00 per radio ($37,800) to further these efforts. Under the LOI, the City is <br />not bound to expend any additional funds other than the good faith payments, and retains <br />the ability to not join the proposed JP A. <br /> <br />The Letter of Intent specifically states "This "Letter of Intent" does not financially bind <br />any jurisdiction beyond the good faith payment, but is necessary in order to begin to <br />develop phasing and cost models for system implementation." In addition, the last <br />paragraph of the LOI states, "The City of San Leandro also understands that signing this <br />Letter of Intent does not obligate the City financially beyond the $100 per radio good <br />faith payment; it merely serves as a basis to identify the level of interest regarding the <br />development and participation in the EBRCS." The City Attorney has reviewed this <br />matter and will be available, if needed, to offer an opinion on the City's obligations under <br />the Letter of Intent. <br /> <br />Subsequent to the Council's approval of the resolution and Letter ofIntent, <br />Councilmember Starosciak requested that the Council reconsider this matter. <br />Councilmember Starosciak also posed a number of questions about the EBRCS, <br />interoperability, and the Letter ofIntent. Police Chief Attarian's and Fire Chief Gilbert's <br />response to these questions is attached. <br /> <br />Procedurally, the Council may take up to two actions regarding this matter. First, the <br />Council will act on a motion to reconsider the resolution and Letter ofIntent. If this <br />motion is not carried, then no further action is necessary. Second, and only if the motion <br />for reconsideration is approved, then the Council can take action in reconsideration of the <br />resolution authorizing the Letter of Intent to support the formation of the EBRCS for <br />Alameda and Contra Costa Counties. <br />
