Holliste~stant City Manager From: Subject: Reconsideration of Letter ofIntent to Support the Formation of the East Bay Regional Communications System (EBRCS) The City Council, at the April 16, 2007 meeting, approved a Letter ofIntent (LOI) to join in the East Bay Regional Communications System Task Force's efforts to create a joint powers authority (JP A) to establish a regional interoperable radio communications system for all jurisdictions in Alameda and Contra Costa Counties. The City Council's unanimous approval of the Letter of Intent (copy attached) also requires a "good faith" payment of $1 00 per radio ($37,800) to further these efforts. Under the LOI, the City is not bound to expend any additional funds other than the good faith payments, and retains the ability to not join the proposed JP A. The Letter of Intent specifically states "This "Letter of Intent" does not financially bind any jurisdiction beyond the good faith payment, but is necessary in order to begin to develop phasing and cost models for system implementation." In addition, the last paragraph of the LOI states, "The City of San Leandro also understands that signing this Letter of Intent does not obligate the City financially beyond the $100 per radio good faith payment; it merely serves as a basis to identify the level of interest regarding the development and participation in the EBRCS." The City Attorney has reviewed this matter and will be available, if needed, to offer an opinion on the City's obligations under the Letter of Intent. Subsequent to the Council's approval of the resolution and Letter ofIntent, Councilmember Starosciak requested that the Council reconsider this matter. Councilmember Starosciak also posed a number of questions about the EBRCS, interoperability, and the Letter ofIntent. Police Chief Attarian's and Fire Chief Gilbert's response to these questions is attached. Procedurally, the Council may take up to two actions regarding this matter. First, the Council will act on a motion to reconsider the resolution and Letter ofIntent. If this motion is not carried, then no further action is necessary. Second, and only if the motion for reconsideration is approved, then the Council can take action in reconsideration of the resolution authorizing the Letter of Intent to support the formation of the EBRCS for Alameda and Contra Costa Counties.
