<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />ORDINANCE NO. 2007-008 <br /> <br />(1413) <br /> <br />AN ORDINANCE AMENDING CHAPTER 4-23, TITLE 4 <br />OF THE SAN LEANDRO MUNICIPAL CODE RELATING TO <br />THE ADDITION OF ACUPUNCTURE AND ACUPRESSURE AS SERVICES <br />REGULATED PURSUANT TO CHAPTER 4-23 <br /> <br />The City Council of the City of San Leandro does ORDAIN as follows: <br /> <br />Section 1. <br /> <br />Chapter 4-23 of Title 4 is hereby renamed as follows: <br /> <br />"CHAPTER 4-23 MASSAGE AND ACUPUNCTURE ESTABLISHMENTS AND <br />SERVICES." <br /> <br />Section 2. Article 1 of Chapter 4-23, Title 4 of the San Leandro Municipal Code is <br />hereby amended to read as follows: <br /> <br />"4-23-100 DEFINITIONS. <br /> <br />"Acupuncture" shall mean the stimulation of a certain point or points on or near the <br />surface of the body by the insertion of needles to prevent or modify the perception of pain or to <br />normalize physiological functions, including pain control, for the treatment of certain diseases or <br />dysfunctions of the body and includes the techniques of electro acupuncture, cupping and <br />moxibustion. <br /> <br />"Acupuncture establishment" shall mean any establishment having a fixed place of <br />business where any person engages in or carries on or permits to be engaged in or carried on any <br />of the activities defined as "acupuncture." <br /> <br />"Acupuncturist" shall mean any person who, for any consideration whatsoever, engages <br />in the practice of acupuncture, as herein defined. <br /> <br />"Applicant" shall mean any person who applies for a permit as required by this Chapter. <br /> <br />"Bona Fide Nonprofit Club" shall mean any fraternal, charitable, religious, benevolent or <br />any other nonprofit organization having a regular membership association primarily for mutual <br />social, mental, political and civic welfare, to which admission is limited to the members and <br />guests and revenue accruing there from is to be used exclusively for the benevolent purposes of <br />said organization and which organization or agency is exempt from taxation under the Internal <br />Revenue Laws of the United States as a bona fide fraternal, charitable, religious, benevolent or <br />nonprofit organization. <br /> <br />949970-2 <br />
