Discussion Regarding Proposed Exclusive Negotiation Agreement with the John
Benjamin Company for Agency-Owned Property at 1595 Washington Avenue

Development Planner Evans reported that the Agency purchased 1595 Washington
Boulevard in 2004 in order to guide the future development of this strategic downtown
comer. Planner Evans then explained the process that City staff carried out to secure a
developer to ultimately develop the property. The City issued an RFP to solicit proposals
from the development community and staff received six proposals, two of which (the
proposals submitted by EF Communities and the John Benjamin Company) were considered
viable development projects. In January, 2007, City staff entered into a letter of intent to
exclusively negotiate with EF Communities. In June, 2007, EF Communities officially
withdrew their development proposal from consideration due to a change in market
conditions. As a result, staff is now recommending that the City Manager proceed with a
letter of intent to exclusively negotiate a Disposition and Development Agreement with the
John Benj amin Company.
