IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2005-004 (1413) <br />AN ORDINANCE ADDING CHAPTER 6 ("NEWSRACK REGULATIONS") TO TITLE 5 <br />("STREETS AND PARKS") OF THE SAN LEANDRO MUNICIPAL CODE <br />WHEREAS, the City of San Leandro ("City") has a substantial governmental <br />interest in promoting the public health, safety, welfare and convenience by ensuring use <br />of the public rights-of-way without unreasonable interference; and <br />WHEREAS, the public health, safety, welfare and convenience require that: <br />unreasonable interference with vehicular or pedestrian traffic is avoided; obstruction of <br />views of traffic, traffic signs and pedestrians is eliminated; damage to sidewalks and <br />streets is minimized and repaired; the good appearance of the public streets, sidewalks <br />and grounds is maintained; trees and other landscaping are allowed to grow <br />undisturbed; access to emergency and other public facilities is maintained; and ingress <br />and egress from properties adjoining public rights-of-way are maintained; and <br />WHEREAS, the unregulated placement of newsracks in public rights-of-way may <br />unreasonably interfere with use of the public rights-of-way, and may present hazards to <br />persons or property; and <br />WHEREAS, the City has a substantial governmental interest in preserving the <br />aesthetic character of the City and its Special Newsrack Districts in particular; and <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN <br />as follows: <br />Section 1. Chapter 6, Newsrack Regulations, is hereby added to Title 5 of the San <br />Leandro Municipal Code as follows: <br />Chapter 6 Newsrack Regulations. <br />Article 1 -General Provisions <br />5-6-100.
