IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2005-022 (1055/1413) <br />AN ORDINANCE REPEALING CHAPTER 1-10, ARTICLE 2, SECTION 1-ll-200, <br />OF TITLE 1 OF THE SAN LEANDRO MUNICIPAL CODE RELATED TO VOLUNTARY <br />EXPENDITURE LIMITS FOR CAMPAIGNS FOR CITY ELECTNE OFFICES <br />WHEREAS, the California Political Reform Act of 1996 was enacted by the voters as <br />Proposition 208, and permitted cities to establish voluntary expenditure limits for candidates for <br />elective office and the controlled committees of such candidates; and <br />WHEREAS, pursuant to the passage of Proposition 208, the City adopted Ordinance No. <br />97-022, establishing a voluntary campaign expenditure limit of $1.00 per resident of the <br />jurisdiction for candidates seeking election to City offices; and <br />WHEREAS, in 1998, a federal district court suspended all of the provisions of Prop 208 <br />pending the outcome of a lawsuit challenging its constitutionality and rendering the City's <br />ordinance unenforceable; and <br />WHEREAS, in November 2000, California voters passed Proposition 34, which repealed <br />most of the provisions of the previously enacted Proposition 208 and invalidated the City's local <br />ordinance. <br />NOW, THEREFORE, the City Council of the City of San Leandro does ordain as <br />follows: <br />SECTION 1. Title 1, Chapter 1-ll, Article 2, Section 1-ll-200 VOLUNTARY <br />EXPENDITURE LIMITS FOR CAMPAIGNS FOR CITY ELECTIVE OFFICES of the City of <br />San Leandro Municipal Code is hereby repealed. <br />SECTION 2. Effective Date and Publication. <br />
