IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2005-025 (1223/2753/3075) <br />AN ORDINANCE AMENDING <br />THE SAN LEANDRO ZONING CODE TO ADD ARTICLE 32 <br />REGARDING CONVERSION OF NON-RESIDENTIAL STRUCTURES <br />TO INDIVIDUAL OWNERSHIP (CONDOMINIUM) UNITS <br />RF.('TTAT,fi <br />A. In 2002, the City of San Leandro adopted a new General Plan, which includes <br />short-term and long-term goals and policies concerning business and industry. <br />B. The General Plan states that the City is committed to "keeping its economy <br />healthy, maintaining a competitive edge within the region, and staying attractive to established <br />and emerging businesses". <br />C. In 2005, the City Council was apprised of a proposed condominium conversion of <br />an office complex, considered through a Parcel Map. The City Council requested that regulations <br />be prepared that require further discretionary review to ensure greater oversight into the <br />conversions of non-residential structures and complexes into individual ownership units, and <br />staff prepared this Ordinance in response to that request. <br />D. This Ordinance does not itself approve or allow the construction of any project <br />and, therefore, has no potential for resulting in physical change in the environment, directly or <br />ultimately. Therefore, adoption of this Ordinance is exempt from environmental review under the <br />California Environmental Quality Act pursuant to Public Resources Code section 21065 based <br />on the finding that this Ordinance is not a "project" within the meaning of Section 15378 of the <br />State CEQA Guidelines. <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as follows: <br />Section 1. Findings. <br />The City Council of the City of San Leandro does hereby find as follows. <br />(A) That the conversion of larger multi-tenanted industrial or commercial <br />properties into smaller ownership units is beneficial to encourage property improvements and to <br />allow ownership opportunities for smaller businesses. <br />(B) That it seeks to protect the welfare of existing tenants of such property and <br />ensure that the overall property is maintained in optimum conditions in both appearance and in <br />structural integrity. <br />
