IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE N0.2004-002 (1035/1076) AN ORDINANCE ADDING SECTION 160 TO ARTICLE 1 OF CHAPTER 5 OF TITLE VII OF THE SAN LEANDRO MUNICIPAL CODE: ADDING WOOD BURNING APPLIANCES The City Council of the City of San Leandro does ORDAIN as follows: Section L Article 1 of Chapter 5 of Title VII of the San Leandro Municipal Code is hereby amended to add the following. Section 7-5-160: Requirements for Wood Burning Appliances. Section 3102.1 to 3102.2 of the Code is deleted and replaced to read as follows: "3102.1 Scope. Chimneys, flues, fireplaces, barbecues and wood burning appliances as set forth below, and their connections, carrying products of combustion shall conform to the requirements of this section. A. All new wood burning appliances installed in residential units. B. All new wood burning appliances installed in commercial buildings (commercial buildings shall include, but not be limited to, hotels and restaurants). C. The conversion of a gas fireplace to burn wood shall constitute the installation of a wood burning appliance and shall be subject to the requirement of this chapter. EXCEPTION: The following shall be exempt from the requirements of this section: L Decorative gas log fireplace; 2. Wood burning appliances used for food preparation or cooking; 3. Remodels or repairs to existing fireplaces. 4. Historical Buildings. 5. Wood burning appliances installed prior to the effective date of this ordinance. 3102.1.1 General requirements. It shall be unlawful to install a wood burning appliance that is not one of the following: A. Apellet-fueled wood heater; B. An EPA certified wood heater; C. A wood burning appliance or masonry fireplace tested by an EPA certified testing laboratory or an approved testing laboratory as designated by the Chief Building Official; D. A wood burning fireplace with a decorative gas log insert; E. A wood burning appliance that has been certified by the Northern Sonoma Air Pollution Control District.
