IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE N0.2004-002 (1035/1076) <br />AN ORDINANCE ADDING SECTION 160 TO ARTICLE 1 OF CHAPTER 5 OF <br />TITLE VII OF THE SAN LEANDRO MUNICIPAL CODE: ADDING WOOD <br />BURNING APPLIANCES <br />The City Council of the City of San Leandro does ORDAIN as follows: <br />Section L Article 1 of Chapter 5 of Title VII of the San Leandro Municipal Code is <br />hereby amended to add the following. <br />Section 7-5-160: Requirements for Wood Burning Appliances. Section 3102.1 to 3102.2 of the <br />Code is deleted and replaced to read as follows: <br />"3102.1 Scope. Chimneys, flues, fireplaces, barbecues and wood burning appliances as set <br />forth below, and their connections, carrying products of combustion shall conform to the <br />requirements of this section. <br />A. All new wood burning appliances installed in residential units. <br />B. All new wood burning appliances installed in commercial buildings (commercial <br />buildings shall include, but not be limited to, hotels and restaurants). <br />C. The conversion of a gas fireplace to burn wood shall constitute the installation of <br />a wood burning appliance and shall be subject to the requirement of this chapter. <br />EXCEPTION: <br />The following shall be exempt from the requirements of this section: <br />L Decorative gas log fireplace; <br />2. Wood burning appliances used for food preparation or cooking; <br />3. Remodels or repairs to existing fireplaces. <br />4. Historical Buildings. <br />5. Wood burning appliances installed prior to the effective date of this ordinance. <br />3102.1.1 General requirements. It shall be unlawful to install a wood burning appliance <br />that is not one of the following: <br />A. Apellet-fueled wood heater; <br />B. An EPA certified wood heater; <br />C. A wood burning appliance or masonry fireplace tested by an EPA certified testing <br />laboratory or an approved testing laboratory as designated by the Chief Building <br />Official; <br />D. A wood burning fireplace with a decorative gas log insert; <br />E. A wood burning appliance that has been certified by the Northern Sonoma Air <br />Pollution Control District. <br />
