IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE N0.2004-008 (1413/2056) <br />AN ORDINANCE AMENDING CHAPTER 3, TITLE 2 <br />OF THE SAN LEANDRO MUNICIPAL CODE ESTABLISHING AN EXEMPTION FROM <br />THE REAL PROPERTY TRANSFER TAX FOR CERTAIN HISTORIC RESOURCES <br />RECITALS <br />A. The City Council of the City of San Leandro adopted Ordinance No. 2003-014 <br />establishing a program of historic preservation of properties within the City. <br />B. Section 4-26-1900 directed the Library-Historical Commission to develop and <br />maintain an incentive program, subject to the Council's approval, that will be <br />available to property owners of designated historic properties to encourage <br />historic preservation, and investment, improvement, and maintenance of historic <br />properties. <br />C. The Commission has recommended that an incentive be provided to qualified <br />historic resources that will exempt property sellers from the payment of the Real <br />Property Transfer Tax imposed by Chapter 2-3 of the San Leandro Municipal <br />Code. <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as <br />follows: <br />Section 1. Anew section 2-3-157 is added to Chapter 3, Title 2 of the San Leandro <br />Municipal Code to read as follows: <br />" 2-3-157 EXEMPTIONHISTORIC RESOURCES <br />Any tax imposed by this Chapter will not apply to the transfer of a historic resource, as <br />that teen is defined in Section 4-26-200(p) of this Code, where a deed restriction has been <br />recorded on the historic resource that requires the owner of the historic resource to comply with <br />Chapter 4-26 of the San Leandro Municipal Code. This deed restriction must be in a form <br />approved by the City Attorney, and must have a term of at least 5 years. This deed restriction <br />must be recorded on the historic resource as part of the transaction to transfer the historic <br />resource." <br />Section 2.
