IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2004-009 <br />(1009/1024/1099) <br />AN ORDINANCE ADOPTING AMENDMENTS TO THE ZONING CODE <br />ARTICLE 6 RELATING TO THE <br />EAST 14TH STREET SOUTH AREA DEVELOPMENT STRATEGY <br />RECITALS <br />A. In April 2004, the City of San Leandro adopted the East 14th Street South Area <br />Development Strategy (Development Strategy) and related amendments to Article 6 of the San <br />Leandro Zoning Code related to the newly created South Area zoning districts. <br />B. In order to ensure consistency with setback requirements and land use regulations <br />included in the Development Strategy, and other provisions in the existing Zoning Code, further <br />revisions to Article 6 are required. <br />C. This Ordinance does not itself approve or allow the construction of any project <br />and, therefore, has no potential for resulting in physical change in the environment, directly or <br />ultimately. Therefore, adoption of this Ordinance is exempt from environmental review under the <br />California Environmental Quality Act pursuant to Public Resources Code section 21065 based <br />on the finding that this Ordinance is not a "project" within the meaning of Section 15378 of the <br />State CEQA Guidelines. The adoption of this Ordinance is further exempt from environmental <br />review pursuant to Section 15305 of the State CEQA Guidelines, because it is a minor change in <br />land use regulations that will not result in any changes to underlying zoning standards. <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as <br />follows: <br />Section I. Sections 2-628, 2-630, 2-632, and 2-680, of Article 6 of the San <br />Leandro Zoning Code are amended as set forth in Exhibit A, which is attached and incorporated <br />by reference into this Ordinance. <br />Section 2. Effective Date and Publication. <br />This ordinance shall take effect thirty (30) days after adoption and the title thereof shall <br />be published once prior to adoption. The City Clerk is directed to post a complete copy thereof <br />on the City Council Chamber bulletin board for five (5) days prior to adoption. <br />687242-1 <br />
