IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2004-014 _(1170/1413) <br />AN ORDINANCE AMENDING TITLE 2 CHAPTER 4 <br />OF THE SAN LEANDRO MUNICIPAL CODE <br />RELATING TO UTILITY USERS TAX <br />The City Council of the City of San Leandro does ORDAIN as follows: <br />Section 1. The City Council finds that the following amendments to the Utility Users Tax <br />Ordinance are necessary to keep the Ordinance current in light of the City's fiscal year 2004-OS <br />budget challenges and changes in the utility services industries. Tha changes do not increase the <br />amount of the Utility Users Tax and do not expand the existing tax base. <br />Section 2. Section 2-4-105 DEFINITIONS of the San Leandro Municipal Code is hereby <br />amended to read as follows: <br />"The following words and phrases whenever used in this Chapter shall be construed as <br />defined in this section: <br />(a) "City" shall mean the City of San Leandro. <br />(b) "Cogenerator" shall mean any corporation or person employing cogeneration as defined <br />in Section 218.5 of the California Public Utilities Code for producing power for the <br />generation of electricity for self use or sale to others from a qualified cogeneration facility (as <br />defined in the federal Public Utility Regulatory Policies Act of 1978 and regulations <br />thereUnder). <br />(c) `Electrical corporation," "gas corporation," and "telephone corporation" shall have the <br />same meanings as defined in sections 218, 222 and 234 respectively of the Public Utilities <br />Code of the State of California. `Electrical corporation" and "gas corporation" shall also be <br />constnied to include any municipality or public agency engaged in the selling or supplying of <br />electrical power or gas to a service user. <br />(d) `Exempt Wholesale Generator" shall have the same meaning as set forth in the Federal <br />Power Act (15 U.S.C.S. 79z-Sa) and regulations thereunder. <br />(e) "Gas" shall mean natural or manufactured gas or any alternate hydrocarbon fuel which <br />maybe substituted therefor. <br />(f) "Mobile Telecommunications Service" has the same meaning and usage as set forth in <br />the Mobile Telecommunications Sourcing Act (4 U.S. C.
