IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE NO. 2004 -020 (1203) AN ORDINANCE AMENDING CHAPTER 2, TITLE 2 OF THE SAN LEANDRO MUNICIPAL CODE RELATING TO BUSINESS LICENSE ENFORCEMENT The City Council of the City of San Leandro does ORDAIN as follows: Section 1. Section 2-2-220(i) of the San Leandro Municipal Code is amended to read as follows: "(i) Firearms Dealer shall mean a person whose business substantially consists of the selling, transferring, or leasing, or advertising for sale, transfer, or lease, or offering or exposing for sale, transfer, or lease, any firearm capable of being concealed upon the person as defined by the Penal Code of the State of California." Section 2. Anew Section 2-2-303 is added to the San Leandro Municipal Code to read as follow: " 2-2-303 SAME LOCATION A separate license must be obtained for each separate business on the same premises. Each license shall authorize the licensee to transact and carry on only the business licensed thereby at the location or in the manner designated in that license; provided, however, that warehouses and distributing plants used in connection with, and incidental to, a business licensed under this Chapter are not deemed to be separate businesses." Section 3. Section 2-2-310 of the San Leandro Municipal Code is amended to read as follows: " 2-2-310 DISPLAY. Every business required to obtain a license under this Chapter must display the license in a conspicuous place upon the premises where the business is conducted. If the licensee does not maintain a fixed place of business within the City or uses a vehicle in the business, licensee shall carry proof of license on their person at all times when engaged in business within the City of San Leandro and shall display a proof of license at the request of any City Officer or employee or any customer or prospective customer." Section 4. Section 2-2-325 of the San Leandro Municipal Code is amended to read as follows: " 2-2-325 LICENSE OR PERMIT. The Finance Director shall not issue any license under this Chapter for the conduct of any business for which another license or permit is required by law until the applicant has first
