Cooke, Principal <br />SUBJECT PROJECT/PROJECT DES <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL <br />Jo Jermanis <br />Ci anager <br />epartment <br />,r ~~ ~~ ~ <br />~w-~~ f <br /><~ <br />ION: <br />MATTER OF ACCEPTING EASEMENTS AND APPROVING AONE-YEAR EXTENSION <br />TO THE SUBDIVISION IMPROVEMENT AGREEMENTS FOR TRACT 7579, LOCATED <br />AT 14953, 14969 AND 14981-14985 WASHINGTON AVENUE, SAN LEANDRO; OWNER <br />AND SUBDIVIDER: WASHINGTON/SPRINGLAKE PROPERTIES, LLC <br />SUMMARY AND RECOMMENDATION <br />Staff has prepared a resolution to accept both an easement for traffic signal construction and <br />maintenance and an easement for utility construction and maintenance across Parcels A, C, and <br />D of Tract 7579, Assessor's Parcel No. 077B-1228-002. A second resolution proposes to extend <br />the subdivision improvement agreements for the subject property by one year. Staff <br />recommends adoption of the resolutions accepting said easements and extending the time of <br />performance of the provisions of the subdivision improvement agreements. <br />BACKGROUND <br />On March 20, 2006 by Resolution No. 2006-028, the City Council approved a final subdivision <br />map and subdivision improvement agreement for Tract 7579; a development project with 43 <br />townhouse units on four parcels. <br />During the course of construction, both the developer and staff discovered that one traffic signal <br />pole and several underground utilities could not be constructed at the locations shown on the <br />improvement plans due to conflicts with other utilities. However, these facilities can be located <br />in the project's common area without impacting function or service, but will require the <br />dedication of additional easements. <br />The developer has installed approximately 95% of the public and private improvements, but has <br />only constructed approximately 50% of the homes. The developer has requested an extension of <br />the time to complete the provisions of the subdivision improvement agreements so that he may <br />construct the remaining homes prior to completion of the required public improvements. <br />
