IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO RESOLUTION NO 2008-009 RDA (3133) RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND CALLING FOR BIDS ON THE DOWNTOWN LIGHTING AND PEDESTRIAN IMPROVEMENT PROJECT, PROJECT NO. 07-961-83-054 RECITALS WHEREAS, California Redevelopment Law at Health and Safety Code Section 33421 authorizes a redevelopment agency to cause the installation of public improvements necessary in the project area for carrying out the redevelopment plan; and WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 provides that a redevelopment agency may, with the consent of the legislative body, pay all or a portion of the value of the land and the cost of the construction of any building, facility, structure, or other improvement which is publicly owned either within or without the project area if it determines all of the following: The buildings, facilities, structures, or other improvements are of benefit to the project area or the immediate neighborhood in which the project is located; and 2. That no other reasonable means of financing the buildings, facilities, structures, or other improvements, are available to the community; and That the payment of funds for the acquisition of land or the cost of buildings, facilities, structures, or other improvements will assist in the elimination of one or more blighting conditions inside the project area; and 4. The project is consistent with the Five Year Implementation Plan adopted by the Agency pursuant to Section 33490; and WHEREAS, the Redevelopment Agency of the City of San Leandro ("Agency") is engaged in the Downtown Lighting and Pedestrian Improvements project in the City's downtown area, including the Plaza Redevelopment Project Area ("Project Area"), which is designed in part to draw people into that area; and WHEREAS, no other reasonable means of financing the installation of the Improvements, is available to the community in that the only other possible source of funding is through the use of the City's General Fund and that is pledged for the provision of essential City services for the residents of the City such as police and fire services; and WHEREAS, the installation of the Improvements, will assist in the elimination of one or more blighting conditions in the Project Area by furthering the implementation of the Downtown Lighting and Pedestrian Improvements project, which will attract patrons to the City's downtown area, including the Project Area, in turn increasing and strengthening existing uses in the Project
