IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE NO. 2003 - 006 (1024) AN ORDINANCE AMENDING PROVISIONS OF THE SAN LEANDRO ZONING CODE RELATING TO CLUBS AND LODGES AND NONCONFORMING CLUB, LODGE, AND RELIGIOUS ASSEMBLY USES WHEREAS, the Religious Land Use and Institutionalized Persons Act of 2000 ("RLUIPA"), 42 U.S.C. Sections 2000cc et seq., has been enacted into law by Congress; and WHEREAS, RLUIPA requires, among other things, that local zoning regulations treat religious assemblies on at least equal terms with comparable nonreligious assemblies; and WHEREAS, it is necessary and desirable to amend various provisions of the San Leandro Zoning Code to conform to the requirements of RLUIPA; and WHEREAS, the City Council of the City of San Leandro finds that the adoption of these Code amendments has no potential to result in a significant effect on the environment, and is thus exempt from the California Environmental Quality Act ("CEQA"), pursuant to sections 15061(b)(3) of the California Code of Regulations (CEQA Guidelines). WHEREFORE, The City Council of the City of San Leandro ordains as follows: SECTION 1. Section 2-606 of the City of San Leandro Zoning Code is hereby amended by removing "Clubs and Lodges" from the list of conditionally permitted uses enumerated in subsection B thereof, as follows: B. CC District -Conditionally Permitted Uses. The following uses are allowed in the CC District, subject to the approval of a conditional use permit. (Certain uses are subject to special requirements and/or limitations, as prescribed following the individual use classification.) I . Accessory Uses in conjunction with a conditionally permitted use. 2. Animal Boarding. 3. Animal Hospitals. 4. Automobile Washing, Unattended. 5. Bars. 6. Bed and Breakfast Inns.
