IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2003 - 006 (1024) <br />AN ORDINANCE AMENDING PROVISIONS OF THE SAN LEANDRO <br />ZONING CODE RELATING TO CLUBS AND LODGES AND <br />NONCONFORMING CLUB, LODGE, AND RELIGIOUS ASSEMBLY USES <br />WHEREAS, the Religious Land Use and Institutionalized Persons Act of 2000 <br />("RLUIPA"), 42 U.S.C. Sections 2000cc et seq., has been enacted into law by Congress; <br />and <br />WHEREAS, RLUIPA requires, among other things, that local zoning regulations <br />treat religious assemblies on at least equal terms with comparable nonreligious <br />assemblies; and <br />WHEREAS, it is necessary and desirable to amend various provisions of the San <br />Leandro Zoning Code to conform to the requirements of RLUIPA; and <br />WHEREAS, the City Council of the City of San Leandro finds that the adoption <br />of these Code amendments has no potential to result in a significant effect on the <br />environment, and is thus exempt from the California Environmental Quality Act <br />("CEQA"), pursuant to sections 15061(b)(3) of the California Code of Regulations <br />(CEQA Guidelines). <br />WHEREFORE, The City Council of the City of San Leandro ordains as follows: <br />SECTION 1. Section 2-606 of the City of San Leandro Zoning Code is hereby amended <br />by removing "Clubs and Lodges" from the list of conditionally permitted uses <br />enumerated in subsection B thereof, as follows: <br />B. CC District -Conditionally Permitted Uses. <br />The following uses are allowed in the CC District, subject to the approval of a conditional <br />use permit. (Certain uses are subject to special requirements and/or limitations, as <br />prescribed following the individual use classification.) <br />I . Accessory Uses in conjunction with a conditionally permitted use. <br />2. Animal Boarding. <br />3. Animal Hospitals. <br />4. Automobile Washing, Unattended. <br />5. Bars. <br />6. Bed and Breakfast Inns. (Subject to the regulations of Section 4-1674: Bed <br />and Breakfast Inns.) <br />7. Billiard Parlors. <br />RLtJIPA Zoning Code Amendments <br />
