IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2003-012 (1413) <br />AN ORDINANCE AMENDING CHAPTER 1-3, ARTICLE I2, SECTION 1-3-1200 OF <br />THE SAN LEANDRO MUNICIPAL CODE RELATED TO MEMBERSHIl' OF THE <br />SITE DEVELOPMENT SUB-COMMISSION TO CHANGE THE NUMBER OF <br />MEMBERS TO THREE <br />WHEREAS, Section 1-306 B of the Zoning Code stipulates that the Site <br />Development Sub-Commission shall have a membership of three (3) members; and <br />WHEREAS, it has been the practice for several years to appoint three (3) <br />members to the Site Development Sub-Commission; and <br />WHEREAS, the Article 12, Section 1-3-1200 of the Municipal Code stipulates a <br />Site Development Sub-Commission membership of five (5) members, which is <br />inconsistent with the Zoning Code and current practice; and <br />WHEREAS, the City Council of the City of San Leandro finds that the adoption <br />of these Code amendments has no potential to result in a significant effect on the <br />environment, and is thus exempt from the California Environmental Quality Act <br />("CEQA"), pursuant to sections 15061(b)(3) of the California Code of Regulations <br />(CEQA Guidelines). <br />WHEREFORE, The City Council of the City of San Leandro ordains as follows: <br />SECTION 1. Article 12, Section 1-3-1200 MEMBERSHIP of the City of San Leandro <br />Municipal Code is hereby amended as follows: <br />"The Site Development Sub-Commission shall consist of three (3) <br />members appointed and qualified in accordance with the provisions of the <br />Zoning Code of the City of San Leandro." <br />SECTION 2. Severability. <br />If any section, subsection, subdivision, paragraph, sentence, clause or phrase of <br />the Ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any <br />court of competent jurisdiction, such decision shall not affect the validity or effectiveness <br />of the remaining portions of this Ordinance or any part hereof. The City Council hereby <br />declares that it would have passed each section, subsection, subdivision, paragraph, <br />sentence, clause and phrase of the Ordinance irrespective of the fact that one or more of <br />them would be declared unconstitutional or invalid. To this end, the provisions of the <br />Ordinance are declared to be severable. <br />
