IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE NO. 2003-016 (2472/2953) AN ORDINANCE OF THE CITY OF SAN LEANDRO AMENDING TITLE 7, CHAPTER 5 OF THE SAN LEANDRO MUNICIPAL CODE TO ADD A NEW SECTION RELATED TO ISSUANCE OF PERMITS TO DEMOLISH OLDER BUILDINGS THE CITY COUNCIL OF THE CITY OF SAN LEANDRO DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: Anew section 126 is added to Title 7, Chapter 5 of the San Leandro Municipal Code to read as follow: "7-5-126 ISSUANCE OF PERMITS TO DEMOLISH A BUILDING Section 106.4.1 is hereby amended to read as follows: Issuance. (a) The application, plans, specifications, computations and other data filed by an applicant for permit shall be reviewed by the building official. Such plans may be reviewed by other departments of this jurisdiction in accordance with State law, Health and Safety Code Section 13146, and in occupancies regulated by the State Fire Marshal, in order to verify compliance with any applicable laws under their jurisdiction. (b) When an application for demolition of a structure is applied for and the building official has cause to believe that the structure may have historical significance, the application may be referred to the Library-Historical Commission for a determination of eligibility. (c) For the purpose of determining historical significance, any structure built prior to 1940 maybe presumed to be potentially significant. (d) An application for a demolition permit may be denied by the building official if the issuance of the permit would result in the destruction in whole or part of a historical resource. (e) If the building official finds that the work described in an application for a permit, and the plans, specifications and other data filed therewith conform to the requirements of this code and other pertinent laws and ordinances, and that the fees specified in Section 107 have been paid, the building official shall issue a permit therefore to the applicant. (f) When the building official issues the permit where plans are required, the building official shall endorse in writing or stamp the plans and specifications APPROVED. Such approved plans and specifications shall not be changed, modified or altered without authorizations from the building official, and all work regulated by this code shall be done in accordance with the approved plans. (g) The building official may issue a permit for the construction of part of a building or structure before the entire plans and specifications for the whole building or structure have been submitted or approved, provided adequate information and detailed statements have been filed complying with all pertinent requirements of this code. The holder of a partial permit shall proceed without assurance that the permit for the entire building or structure will be granted." SECTION 3: SEVERABILITY If any section, subsection, subdivision, paragraph, sentence, clause or phrase of the ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any court of competent
