IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2003-016 (2472/2953) <br />AN ORDINANCE OF THE CITY OF SAN LEANDRO AMENDING TITLE 7, CHAPTER 5 <br />OF THE SAN LEANDRO MUNICIPAL CODE TO ADD A NEW SECTION RELATED TO <br />ISSUANCE OF PERMITS TO DEMOLISH OLDER BUILDINGS <br />THE CITY COUNCIL OF THE CITY OF SAN LEANDRO DOES HEREBY ORDAIN AS <br />FOLLOWS: <br />SECTION 1: Anew section 126 is added to Title 7, Chapter 5 of the San Leandro Municipal <br />Code to read as follow: <br />"7-5-126 ISSUANCE OF PERMITS TO DEMOLISH A BUILDING <br />Section 106.4.1 is hereby amended to read as follows: <br />Issuance. (a) The application, plans, specifications, computations and other data filed by an <br />applicant for permit shall be reviewed by the building official. Such plans may be reviewed by <br />other departments of this jurisdiction in accordance with State law, Health and Safety Code <br />Section 13146, and in occupancies regulated by the State Fire Marshal, in order to verify <br />compliance with any applicable laws under their jurisdiction. <br />(b) When an application for demolition of a structure is applied for and the building official has <br />cause to believe that the structure may have historical significance, the application may be <br />referred to the Library-Historical Commission for a determination of eligibility. <br />(c) For the purpose of determining historical significance, any structure built prior to 1940 maybe <br />presumed to be potentially significant. <br />(d) An application for a demolition permit may be denied by the building official if the issuance <br />of the permit would result in the destruction in whole or part of a historical resource. <br />(e) If the building official finds that the work described in an application for a permit, and the <br />plans, specifications and other data filed therewith conform to the requirements of this code and <br />other pertinent laws and ordinances, and that the fees specified in Section 107 have been paid, the <br />building official shall issue a permit therefore to the applicant. <br />(f) When the building official issues the permit where plans are required, the building official <br />shall endorse in writing or stamp the plans and specifications APPROVED. Such approved plans <br />and specifications shall not be changed, modified or altered without authorizations from the <br />building official, and all work regulated by this code shall be done in accordance with the <br />approved plans. <br />(g) The building official may issue a permit for the construction of part of a building or structure <br />before the entire plans and specifications for the whole building or structure have been submitted <br />or approved, provided adequate information and detailed statements have been filed complying <br />with all pertinent requirements of this code. The holder of a partial permit shall proceed without <br />assurance that the permit for the entire building or structure will be granted." <br />SECTION 3: SEVERABILITY <br />If any section, subsection, subdivision, paragraph, sentence, clause or phrase of the ordinance is <br />for any reason held to be unconstitutional, invalid, or ineffective by any court of competent <br />
