,/~ <br />~/ <br />ASSIGNMENT AND CONSENT FOR ~~ <br />LICENSE AGREEMENT FOR PROPERTY LOCATED AT <br />1371 EAST 14T" STREET APN: 077-054 - <br />( 5 007-00) <br />AND <br />USE AGREEMENT BETWEEN <br />THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />AND BEAUTY GALLERIA FOR THE USE OF <br />REDEVELOPMENT AGENCY TRASH ENCLOSURE <br />This Agreement is made by and between Cindy Chan and Edgar M J Sung <br />( Assignee ), the City of San Leandro ("City"), and the Redevelopment Agency of the <br />City of San Leandro ("Agency") and is effective as noted herein. <br />RECITALS <br />A. On February 22, 2005, a License Agreement ("License") was entered into <br />between City and Song Yun ("Owner"), owner of the property at 1371 East 14'h Street, <br />APN 077-0545-007-00, and commonly known as The Beauty Galleria building, pursuant <br />to City Council Resolution 2005-018, which is attached hereto and incorporated herein <br />by this reference, to enter upon and use the adjacent property of City as shown on <br />Exhibit A of said License for a glass enclosed storefront entry area. <br />B. On July 1, 2005, Owner and Agency entered into that certain Use <br />Agreement for. the use of the Redevelopment Agency's trash enclosure ("Use <br />Agreement"), which is attached hereto and incorporated herein by this reference, to <br />enter upon and use the Agency owned trash enclosure constructed adjacent to 116 <br />West Joaquin Street. <br />C. By letter dated March 13, 2006, Agent of Song Yun advised City and <br />Agency that property had been sold and requested assignment of all rights and <br />covenants of said License and Use Agreement to the new owners, Cindy Chan and <br />Edgar M J Sung ("Assignee"). <br />D. Section 19 of License and Section 7 of Use Agreement provide that said <br />assignment is prohibited without the express written consent of the City. <br />E. Assignee hereby declares its intent to assume all the duties, obligations <br />and covenants as Licensee/User, pursuant to the terms of the agreements referenced in <br />paragraphs A and B. <br />F. Further, Assignee requests that Section 11 of License and Section 10 of <br />Use Agreement relating to Notices be amended to reflect new Licensee/User contact <br />
