IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE N0.2008-016 (2624) <br />AN ORDINANCE AMENDING CHAPTER 4-1, ARTICLE 7 <br />OF THE SAN LEANDRO MUNICIPAL CODE <br />RELATING TO ALCOHOLIC BEVERAGES <br />The City Council of the City of San Leandro does ORDAIN as follows: <br />Section 1. Chapter 4-1, Article 7 of the San Leandro Municipal Code is hereby <br />amended in its entirety to read as follows: <br />"ARTICLE 7. ALCOHOLIC BEVERAGES <br />4-1-700 DEFINITIONS. <br />As used in this Article, the following words and phrases shall mean: <br />(a) "Alcoholic beverage" shall mean and include alcohol, spirits, liquor, wine, beer, <br />and every liquid or solid containing alcohol, spirits, wine, or beer that contains one-half of one <br />percent (0.5%) or more of alcohol by volume and which is fit for beverage purposes alone or <br />when diluted, mixed, or combined with other substances. <br />(b) "Open container" shall include, but not limited to, any bottle, can thermal jar or <br />jug, vessel, or other receptacle which is open, has been opened, or which has a seal broken, or <br />the contents of which have been partially removed. <br />4-1-705 DRINKING IN CITY PARKS AND OPEN SPACE AREAS. <br />No person shall consume or be in possession of any open container of any alcoholic <br />beverage in any City park or open space area, except for City sponsored events with prior <br />approval from the City Council. <br />4-1-710 DRINKING ON STREETS. <br />No person shall consume, drink, exhibit or possess an open container of any alcoholic <br />beverage on any street, sidewalk, alley, or highway. This Section shall not be deemed to make <br />punishable any act or acts which are prohibited by any law of the State of California. <br />4-1-715 DRINKING IN PARKING LOTS. <br />No person shall consume, drink, exhibit or possess an open container of any alcoholic <br />beverage upon that portion of public or private property open to the public and within five <br />hundred (500) feet of any public street, sidewalk, alley or highway and used or intended to be <br />
