IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2004-008 RDA (2888) <br />RESOLUTION APPROVING THE REUSE REPORT REQUIRED BY HEALTH AND <br />SAFETY CODE SECTION 33433 AND THE DISPOSITION AND DEVELOPMENT <br />AGREEMENT BETWEEN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN <br />LEANDRO AND 1040 DAMS PARTNERSHIP LLC FOR THE DISPOSITION AND <br />DEVELOPMENT OF THE PROPERTY LOCATED AT 1016, 1040, 1048, AND 1052 DAMS <br />STREET (APNS: 075-0148-05, 075-0148-06-01, 075-0148-07, 075-0148-08-02) <br />RECITALS <br />WHEREAS, the Agency has negotiated a Disposition and Development Agreement <br />("Agreement") between the Agency and 1040 Davis Partnership LLC ("Developer") to develop <br />an office complex at 1016-1052 Davis Street, which will further the purposes of the Plaza <br />Redevelopment Plan; and <br />WHEREAS, the Agreement provides for the Agency to convey the four parcels at 1016- <br />1052 Davis Street (the "Property") to Developer for consideration in the amount of $181,500; <br />and <br />WHEREAS, the Agency has caused to be prepared a report required by the Health and <br />Safety Code §33433 ("Reuse Report") which contains a summary of the proposed Agreement to <br />be entered into between the Agency and Developer and a summary of the cost of the Agreement <br />to the Agency; and <br />WHEREAS, the summary of the cost of the Agreement includes: land acquisition costs, <br />clearance costs, remediation costs, administrative costs, the estimated value of the interest to be <br />conveyed determined at the highest and best uses permitted under the project plan, the estimated <br />value of the interest to be conveyed determined at use with conditions, covenants, and <br />development costs required by the sale; and an explanation of why the sale of the property will <br />assist in the elimination of blight; and <br />WHEREAS, the Agency has made the Reuse Report available for public inspection <br />pursuant to Health and Safety Code §33433; and <br />WHEREAS, the Agency has held a properly noticed public hearing and taken all other <br />actions required by law to prepare and present the Reuse Report; and <br />WHEREAS, the Agency does hereby take official notice of all documents, surveys, <br />records and reports maintained in the ordinary course of business by the Agency and the City of <br />San Leandro relating to the real properties which are the subject of the Reuse Report, and the <br />Agency has considered the report and recommendations regarding the Reuse Report, and has <br />
