IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2004-008 RDA (2888) RESOLUTION APPROVING THE REUSE REPORT REQUIRED BY HEALTH AND SAFETY CODE SECTION 33433 AND THE DISPOSITION AND DEVELOPMENT AGREEMENT BETWEEN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO AND 1040 DAMS PARTNERSHIP LLC FOR THE DISPOSITION AND DEVELOPMENT OF THE PROPERTY LOCATED AT 1016, 1040, 1048, AND 1052 DAMS STREET (APNS: 075-0148-05, 075-0148-06-01, 075-0148-07, 075-0148-08-02) RECITALS WHEREAS, the Agency has negotiated a Disposition and Development Agreement ("Agreement") between the Agency and 1040 Davis Partnership LLC ("Developer") to develop an office complex at 1016-1052 Davis Street, which will further the purposes of the Plaza Redevelopment Plan; and WHEREAS, the Agreement provides for the Agency to convey the four parcels at 1016- 1052 Davis Street (the "Property") to Developer for consideration in the amount of $181,500; and WHEREAS, the Agency has caused to be prepared a report required by the Health and Safety Code §33433 ("Reuse Report") which contains a summary of the proposed Agreement to be entered into between the Agency and Developer and a summary of the cost of the Agreement to the Agency; and WHEREAS, the summary of the cost of the Agreement includes: land acquisition costs, clearance costs, remediation costs, administrative costs, the estimated value of the interest to be conveyed determined at the highest and best uses permitted under the project plan, the estimated value of the interest to be conveyed determined at use with conditions, covenants, and development costs required by the sale; and an explanation of why the sale of the property will assist in the elimination of blight; and WHEREAS, the Agency has made the Reuse Report available for public inspection pursuant to Health and Safety Code §33433; and WHEREAS, the Agency has held a properly noticed public hearing and taken all other actions required by law to prepare and present the Reuse Report; and WHEREAS, the Agency does hereby take official notice of all documents, surveys, records and reports maintained in the ordinary course of business by the Agency and the City of San Leandro relating to the real properties which are the subject of the Reuse Report, and the Agency has considered the report and recommendations regarding the Reuse Report, and has
