IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2004-012 RDA (1485) RESOLUTION MAKING HEALTH AND SAFETY CODE SECTION 33445 FINDINGS; AUTHORIZING THE AGENCY TO PURCHASE A PORTION OF THE PROPERTY AT 1267 WASHINGTON AVENUE IN SAN LEANDRO AND A TEMPORARY CONSTRUCTION EASEMENT; AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE A PURCHASE AND SALE AGREEMENT FOR THE PURCHASE OF SAID REAL PROPERTY; AND ACCEPTING THE CONVEYANCE BY GRANT DEED OF SAID REAL PROPERTY TO THE REDEVELOPMENT AGENCY RECITALS WHEREAS, California Redevelopment Law at Health and Safety Code Section 33391 authorizes a redevelopment agency to purchase real property for purposes of redevelopment; and WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 provides that a redevelopment agency may, with the consent of the legislative body, pay all or a portion of the value of the land and the cost of the construction of any building, facility, structure, or other improvement which is publicly owned either within or without the project area if it determines all of the following: The buildings, facilities, structures, or other improvements are of benefit to the project area or the immediate neighborhood in which the project is located; and 2. That no other reasonable means of financing the buildings, facilities, structures, or other improvements, are available to the community; and That the payment of funds for the acquisition of land or the cost of buildings, facilities, structures, or other improvements will assist in the elimination of one or more blighting conditions inside the project area; and 4. The project is consistent with the Five Year Implementation Plan adopted by the Agency pursuant to Section 33490; and
