IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO 2004-016 RDA (1485/D-1372) <br />RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />MAKING HEALTH AND SAFETY CODE SECTION 33445 FINDINGS; AUTHORIZING <br />THE AGENCY TO FUND THE CITY'S PURCHASE OF EDEN ROAD <br />(APN: 042-4530-005-02) IN AN AMOUNT NOT TO EXCEED $40,000; AND <br />AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE ALL RELATED <br />DOCUMENTS <br />RECITALS <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33391 <br />authorizes a redevelopment agency to purchase real property for purposes of redevelopment; and <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 <br />provides that a redevelopment agency may, with the consent of the legislative body, pay all or a <br />portion of the value of the land and the cost of the construction of any building, facility, <br />structure, or other improvement which is publicly owned either within or without the project area <br />if it determines all of the following: <br />1. The buildings, facilities, structures, or other improvements are of benefit to the <br />project area or the immediate neighborhood in which the project is located; and <br />2. That no other reasonable means of financing the buildings, facilities, structures, or <br />other improvements, are available to the community; and <br />3. That the payment of funds for the acquisition of land or the cost of buildings, <br />facilities, structures, or other improvements will assist in the elimination of one or <br />more blighting conditions inside the project area; and <br />4. The project is consistent with the Five Year Implementation Plan adopted by the <br />Agency pursuant to Section 33490; and <br />
