IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO 2004-018 RDA (103411485) <br />RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />APPROVING THE PURCHASE OF REAL PROPERTY FROM THE EAST BAY <br />MUNICIPAL UTILITY DISTRICT AND THE EXECUTION OF AN AGREEMENT FOR <br />SALE OF REAL PROPERTY <br />RECITALS <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33391 <br />authorizes a redevelopment agency to purchase real property for purposes of redevelopment; and <br />WHEREAS, the East Bay Municipal Utility District ("District") owns certain real <br />property (the "Property") located in the Joint Project Area, commonly known as 1595 <br />Washington Avenue and more particularly described in the Grant Deed attached hereto as <br />Exhibit A; and <br />WHEREAS, the Redevelopment Agency of the City of San Leandro ("Agency") wishes <br />to acquire the Property with bond proceeds from the Plaza Redevelopment Project Area; and <br />WHEREAS, Agency staff has secured the opinion of Bond Counsel that use of the bond <br />proceeds from the Plaza Redevelopment Project Area for acquisition of the Property is an <br />allowable use; and <br />WHEREAS, subsequent to the acquisition of the Property, the Agency intends to <br />exchange the Property with privately-owned property located in the Plaza Redevelopment <br />Project Area; and <br />WHEREAS, acquisition of the Property will benefit the Plaza Redevelopment Project <br />Area because the subsequent property exchange will allow the Agency to acquire property in the <br />Plaza Redevelopment Project Area, which the Agency intends to then use for purposes of <br />redevelopment, including the elimination of blight in the Plaza Redevelopment Project Area. <br />
