IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO RESOLUTION NO 2004-018 RDA (103411485) RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO APPROVING THE PURCHASE OF REAL PROPERTY FROM THE EAST BAY MUNICIPAL UTILITY DISTRICT AND THE EXECUTION OF AN AGREEMENT FOR SALE OF REAL PROPERTY RECITALS WHEREAS, California Redevelopment Law at Health and Safety Code Section 33391 authorizes a redevelopment agency to purchase real property for purposes of redevelopment; and WHEREAS, the East Bay Municipal Utility District ("District") owns certain real property (the "Property") located in the Joint Project Area, commonly known as 1595 Washington Avenue and more particularly described in the Grant Deed attached hereto as Exhibit A; and WHEREAS, the Redevelopment Agency of the City of San Leandro ("Agency") wishes to acquire the Property with bond proceeds from the Plaza Redevelopment Project Area; and WHEREAS, Agency staff has secured the opinion of Bond Counsel that use of the bond proceeds from the Plaza Redevelopment Project Area for acquisition of the Property is an allowable use; and WHEREAS, subsequent to the acquisition of the Property, the Agency intends to exchange the Property with privately-owned property located in the Plaza Redevelopment Project Area; and WHEREAS, acquisition of the Property will benefit the Plaza Redevelopment Project Area because the subsequent property exchange will allow the Agency to acquire property in the Plaza Redevelopment Project Area, which the Agency intends to then use for purposes of redevelopment, including the elimination of blight in the Plaza Redevelopment Project Area.
