IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2004-019 RDA (2888) RESOLUTION APPROVING AN AMENDMENT TO THE DISPOSITION AND DEVELOPMENT AGREEMENT BETWEEN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO AND 1040 DAMS PARTNERSHIP LLC FOR THE DISPOSITION AND DEVELOPMENT OF THE PROPERTY LOCATED AT 1016, 1040, 1048, AND 1052 DAMS STREET (APNS: 075-014$-O5, 075-0148-06-01, 075-0148-07, 075-014$-08-02) RECITALS WHEREAS, the Agency has approved a Disposition and Development Agreement ("Agreement") between the Agency and 1040 Davis Partnership LLC ("Developer") to develop an office complex at 1016-1052 Davis Street, which will further the purposes of the Plaza Redevelopment Plan; and WHEREAS, pursuant to the Agreement, Developer has submitted a Financing Plan to Agency, and as a result thereof has requested a change to the Development Plan to renovate and expand the existing building on the site rather than renovate the existing building and construct a new building; and WHEREAS, the Agency has caused to be prepared a report required by the Health and Safety Code § 33433 ("Reuse Report") which contains a summary of the proposed Agreement to be entered into between the Agency and Developer and a summary of the cost of the Agreement to the Agency; and WHEREAS, the Agency desires to amend the Agreement to remove the requirement to construct a second building and allow Developer to expand the square footage of the existing building; and WHEREAS, the amendment will result in no increase in the cost of the Agency's financial obligation as analyzed in the Reuse Report; and WHEREAS, the Agency is familiar with the contents of the Amendment; and WHEREAS, the Executive Director recommends approval of the Amendment; NOW, THEREFORE, the Redevelopment Agency of the City of San Leandro hereby resolves as follows: Section 1. The Amendment to the Disposition and Development Agreement between the Agency and 1040 Davis Partnership, LLC is hereby approved.
