IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2009-002 RDA (1485/3037) <br />A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN <br />LEANDRO APPROVING A FINANCING AGREEMENT BETWEEN THE <br />REDEVELOPMENT AGENCY AND THE SAN LEANDRO UNIFIED SCHOOL DISTRICT, <br />AUTHORIZING THE EXPENDITURE OF TAX INCREMENT FUNDS FOR PUBLIC <br />IMPROVEMENTS AND PUBLIC FACILITIES IN CONNECTION THEREWITH, AND <br />ADOPTING FINDINGS REQUIRED BY <br />HEALTH AND SAFETY CODE SECTIONS 33445 AND 33679 <br />WHEREAS, the Redevelopment Agency of the City of San Leandro (the "Agency") is <br />responsible for carrying out redevelopment of the Alameda County-City of San Leandro (Joint) <br />Redevelopment Project Area (the "Project Area") in the City of San Leandro in accordance with <br />the Redevelopment Plan and the California Community Redevelopment Law (Health and Safety <br />Code Sections 33000 et seq.) (the "CRL"), including the construction and installation of public <br />improvements consistent with the Redevelopment Plan; and <br />WHEREAS, the San Leandro Unified School District (the "District") proposes to enter <br />into an agreement (the "Joint Use Agreement") with the City of San Leandro (the "City") for <br />the joint use of a new school gymnasium to be constructed within the Project Area (together with <br />related public improvements, the "Project"), in consideration of financial assistance from the <br />Agency for the construction of the Project; and <br />WHEREAS, Section 33445 of the CRL provides that a redevelopment agency may, <br />with the consent of the legislative body, pay all or a portion of the cost of the construction of any <br />building, facility, structure, or other improvements that is publicly owned either within or <br />without the project area if it determines all of the following: <br />a. The buildings, facilities, structures, or other improvements are of benefit to the <br />project area or the immediate neighborhood in which the project is located; and <br />b. That no other reasonable means of financing the buildings, facilities, structures, or <br />other improvements are available to the community; and <br />c. That the payment of funds for the cost of buildings, facilities, structures, or other <br />improvements will assist in the elimination of one or more blighting conditions inside the project <br />area; and <br />d. The project is consistent with the Five Year Implementation Plan adopted by the <br />Agency pursuant to Section 33490; and <br />WHEREAS, the Agency desires to approve an agreement (the "Financing Agreement") <br />pursuant to which the Agency would provide Project construction financing to the District in the <br />
