1N THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2009-011 RDA (3110/3117) <br />RESOLUTION MAKING DETERMINATIONS WITH RESPECT TO CEQA, <br />APPROVING A PURCHASE AND SALE AGREEMENT, AUTHORIZING AN <br />INTER-PROJECT AREA LOAN, AND AUTHORIZING THE EXPENDITURE OF <br />TAX INCREMENT FUNDS FOR THE ACQUISITION OF REAL PROPERTY <br />WHEREAS, by Ordinance No. 93-012 the City Council and the Redevelopment <br />Agency of the City of San Leandro (the "Agency") established the Alameda County - <br />City of San Leandro (Joint) Redevelopment Project Area (the "Project Area") and <br />adopted a redevelopment plan for the Project Area (as thereafter amended, the <br />"Redevelopment Plan"); <br />WHEREAS, the Agency is responsible for carrying out the redevelopment of the <br />Project Area in accordance with the California Community Redevelopment Law (Health <br />and Safety Code Sections 33000 et seq.) (the "CRL"), the Redevelopment Plan and the <br />Implementation Plan adopted in connection therewith (the "Implementation Plan"); <br />WHEREAS, the San Leandro City Council and the governing board of the <br />Agency have approved execution of that certain Settlement Agreement and General <br />Release of All Claims dated as of April 20, 2009 (the "Settlement Agreement"), <br />pursuant to which the Agenc~ agreed to purchase certain real property located in the <br />Project Area at 1550 East 14 Street and known as Alameda County Assessor's Parcel <br />No. 077-0540-009-00 (the "Property"); <br />WHEREAS, the Agency's purchase of the Property will assist in the elimination <br />of blight in the Project Area, and will facilitate the redevelopment of the Property in <br />accordance with the Redevelopment Plan and the Implementation Plan; <br />WHEREAS, the City and the Agency contemplate that any temporary use and <br />any future development and use of the Property will be for uses contemplated by and <br />consistent with the Transit Oriented Development Strategy ("TOD Strategy") plan and <br />implementing ordinances adopted by the City of San Leandro ("City") in September, <br />2007. <br />WHEREAS, Agency staff and the owner of the Property have negotiated a <br />purchase and sale agreement (the "Purchase and Sale Agreement"), a copy of which <br />has been provided to the Agency governing board and is on file with the Agency <br />Secretary; <br />WHEREAS, the Agency proposes to provide partial financing for the acquisition <br />of the Property with the proceeds of a loan (the "Loan") in the amount of Two Million <br />Four Hundred and Seventy-Five Thousand Dollars ($2,475,000) from the West San <br />Leandro/MacArthur Boulevard Redevelopment Project Area pursuant to the terms and <br />
